The Corporate Affairs Commission, CAC, has said that it will no longer accept the resignation or sudden retirement without prior three months notice or a month notice.

This is contained in a circular dated October 4, 2021, made available to TheNigeriaLawyer signed by Director of Human Resources, Mrs. Olayemi Oyeniyi. Mrs. Oyeniyi explained that the purpose of the insistence on compliance with the Notice requirement is to ensure appropriate succession planning in the affected Departments/Units or State Offices.

“This is to notify staff that henceforth the Commission will no longer accept sudden Resignation or Voluntary Retirement without the mandatory 1 month or 3 months’ notice as stipulated in the Commission’s Conditions of Service. This is to ensure appropriate succession planning in the affected Departments/Units or State Offices” the Notice reads in part.

The Commission further explains that should a staff choose to pay in lieu of the Notice, the staff shall pay and attach evidence of payment to the resignation letter. The Commission warned that it will no longer entertain deduction of money from exit benefits

CAC stated, “However, in cases of exit without prior mandatory notice,staff must pay the in-lieu of notice upfront and attach the evidence of payment to their letters of Resignation or Voluntary Retirement as the case may be.

“NOTE that instruction to deduct the in-lieu of notice from exit benefit will no longer be entertained.

Please be rightly guided.”

Law & Society Website reports that there has been mass resignation from the Commission due to alleged high-handedness, massive corruption, and gross incompetence of the Registrar General (RG) of the Corporate Affairs Commission (CAC), Alhaji Garba Abubakar.

Members of the Commission’s top management have allegedly been resigning in droves.

The massive resignations are said to be at all levels – Directors, middle Management, and other Cadres. For instance, that four Senior Directors resigned within 6 months after Abubakar assumed office as the new Registrar.

“In his first six months, the Directors of Administration, Finance, Procurement, Human Resources, resigned en-mass! Too many people are leaving CAC. This is the first time over 200 people are leaving an office within a year; hence the rather unwarranted illegal Circular.

Besides, the decision as contained in the Circular which is contrary to the CAC Staff Conditions of Service was not discussed at any Management meeting but the unilateral decision of the RG. Besides Over 30 members of Staff who were past and present Union members and those perceived to be loyal to the Union have been transferred to different State Offices across the Country. Note that this is not based on manpower needs of the Commission but as a vendetta to destabilize the Union and its activities.

In addition, any Member of Staff perceived to be loyal to the Lady Azinge led past administration was subjected to transfer out of Head Office as a means of settling scores and destabilizing such Staff.” a staff said on condition of anonymity

The anonymous staff said the action of the Registrar is contrary to the admonition of the Hon. Ministers of Industry, Trade and Investment, Otunba Adeniyi Adebayo and Hajiya Aisha Abubakar to the Registrar during the presentation of his Letter of Appointment, not to “use his appointment as an opportunity to settle scores or embark on vendetta” given the bad blood that the Commission witnessed for 2 years of the vacancy of the RG position. Both Honourable Ministers offered to “carry out close oversight” functions over CAC.
