An Abuja-based lawyer and a human rights activist, Maxwell Opara Esq., has asked Imo state House of Assembly to stop Chukwuma Onyeocha Esq.,  from parading himself as the President General of Amuzi Community because he is unfit for the exalted position.

He accused him of Criminal Invasion, illegal destruction of property without a valid court order.

This was disclosed in a letter addressed to Hon. Nkem Sam Otuibe, member representing Ahiazu L.G.A, Imo State House of Assembly, dated 12th April, 2021 and sighted by THENIGERIALAWYER(TNL).

Maxwell is also calling for the suspension of Kingsley Omire, his PRO.

In the letter titled: “Appeal for Suspension and Direct the duo from parading themselves as President General and PRO of Amuzi Community Respectively, Maxwell also accused them of Criminal Trespass, Malicious Damage to Property, Attempt to commit Arson, stealing, and Threat to Life.

According to the letter Maxwell said he built 26 rooms with 100 capacity Hall 2 story Hotel within his community “Amuzi” having legally acquired the land.

“Incidentally and regrettably, since I started the project which I see as a way of contributing to the development of my community in particular and Imo State in general, some disgruntled, envious and greedy persons in my Amuzi community have been clandestinely fighting to frustrate the project but God has continued to give me victory over them.

“Now, having completed the project and started building the fence in line with the Survey flowing from the other person who had earlier built his own, the same enemies of progress led by one Barr. Chukwuma Onyeocha who is the President General of the community came to tell me that my fence encroached into the community land with about 6 inches. I told them that I built it in line with others and the survey plan given to me by the original owner through the seller. After brief discussions with them on Tuesday 7th April , 2021, we scheduled for a meeting on Saturday 10th of April, 2021 to finally look into the matter. Unfortunately, to my greatest surprise, shock, disappointment, disbelief and amazement,  on Friday 9th April, 2021, between the hours of 11a.m and 12 noon, I was called to understand that Barr. Chukwuma Onyeocha had mobilized some hoodlums who appeared like  drug addicts to criminally trespass into the premises of the hotel, brought down the fence structures, beat up my workers and looted properties worth millions of Naira.

“On my arrival at the scene, while the criminality and heinous attacks/invasion were going on, I tried to confirm what was going on from the prime suspect and the leader of these lawless people Barr. Chukwuma Onyeocha, threatened that “after destroying the property, they will come after me and that my days are numbered in Amuzi community.

” As a law-abiding citizen, I immediately rushed to the two traditional Rulers in the community in the persons of Eze Dr.James Okoronkwo and Eze Sir Innocent Ugochukwu in order to confirm if they jointly or severally had knowledge of the action of those people being custodians of cultures and traditions of the community as well as chief Security Officers. To my utter disbelief and consternation, the duo denied having knowledge of the incident, in as Amuzi as an entity, and also never sent anyone to my Hotel. They further condemned the action which is seen as illegality.

“As a further confirmation of the true position, I contacted many of the stakeholders in Amuzi community,which include inter alia the following:  components village Chairmen and Secretaries, Amuzi Abroadians chairmen and secretaries, the Traditional Prime Ministers of Amuzi community. All of these, denied knowledge and ever being consulted.

Maxwell went on to ask certain questions:
1. Was there any resolution by Amuzi community to embark on such illegality?
2. If yes, who are the persons that signed it?
3. Can someone take an action in the name of a community without the consent of the Traditional Ruler of that community?
4.How can a Lawyer who ought to know better not only plan to commit such illegalities, but also he physically participated in trespassing into somebody’s premises without any lawful court order, pulling down and destroying a structure?

He further asked;  If it was not because of envy and greed, is that the best way to handle such an issue?

He noted that if he hadn’t restrained his security men, workers and relatives who wanted to take some reactionary actions, the scenario would have turned some blood shade.

“This action of taking laws into one’s hand is condemnable and inexplicable especially now that IMO State in particular and Southeast, in general, are battling with insecurity and criminalities,” he stated.

He went on to urge Hon. Nkem Sam to implore the use of his good office to present this ugly incident before the Imo State House of Assembly with a view to stopping Barr.Chukwuma Onyeocha from parading himself as the President General of Amuzi Community because he is not fit and proper to hold that office.

“Also sir, try to bring the attention of this ugly incident to His Excellency, the Hardworking Governor of Imo State through the office of the commissioner for Chieftaincy Affairs.

“We have breakdown of law and order in Amuzi community as a result of illegal activities of Barr. Chukwuma Onyeocha,” he said.

Speaking with the Traditional Ruler of Amuzi Community, Eze Innocent Ugochukwu told THENIGERIALAWYER(TNL), that the matter is in their hands and that between now and tomorrow, Maxwell will hear from the two traditional rulers.
“Maxwell can take my words. The matter is completely in our hands, the two traditional rulers by this time tomorrow he will get our message,” Eze Ugochukwu said.

President General Chukwuma Onyeocha, Esq., while speaking with TNL, denied the allegations and said it was Maxwell who used thugs against them.

And when asked why no court injunction was obtained before demolishing the fence, Onyeocha, said courts are on strike.

Chairman Elders Council, Hon. Francis Onyekwere, told THENIGERIALAWYER, that the space encroached by Maxwell, was community land and that consent was not given to Maxwell before he went to erect the fence.

He said the land that Maxwell bought was fenced right round and that was the boundary according to the survey of the land.

“When Maxwell bought the land, he approached me that his building has no space and was having a stench look because there was no space beside the wall of the hotel and based on that he was applying if possible for the community to give him some space.

“The space is not for entrance because the hotel premises has an entrance. I told him okay, that I will discuss it with the council, this was last year, November, December.

“I assured him there will be consultations because it was an ancestral land. After several Constitutions, the community said, it was not convenient because it will be an obstruction.

“We have not communicated to him.  To my surprise on Monday, I was informed about the erection of the fence, though Maxwell denied having knowledge of it and swore that he will get it stopped if work was going on there. And if the community does not approve of it he will pull it down.

“On Tuesday, I got the same message that working was going on and I called on Maxwell to the place and he saw things with his eyes.

“I was disappointed because we never gave the land to him and he was not contesting with anyone and he failed to personally honour our invitation,” he added.

When asked who gave the order for the demolition, he said it was from the Elders
