The Kano State High Court has granted an order restraining Governor Abdullahi Ganduje from implementing the breakup of Kano Emirate.

Mr Ganduje signed a law on Wednesday which created additional four emirates, a move that was widely seen as a depletion of Emir Lamido Sanusi’s influence.

The matter immediately took a political dimension with the Peoples Democratic Party members in the House saying that the additional four emirates were not properly created, accusing the All Progressives Congress majority of disregarding extant parliamentary procedures.

Hon. Rabiu Sule Gwarzo  filed a Motion Exparte against the Speaker of Kano State House of Assembly, the Kano State House of Assembly itself, Clerk of Kano State House of Assembly, Governor of Kano State, Attorney-General of Kano State and Government Printer. The Motion was dated 10th day of May, 2019 and filed on the same date seeking for the following reliefs:

  1. AN ORDER OF INTERIM INJUNCTION directing all parties in this suit maintaining status quo pending the hearing and determination of the Motion on Notice
  2. AN ORDER OF INTERIM INJUNCTION directing the Defendant/Respondents to halt the publication and release of the law assented May 08, 2019 namely Kano State Emirs (appointment and Deposition) (Amendment) Law, 2019 (1440 AH) pending the hearing and determination of the Motion on Notice
  3. AN ORDER OF INTERIM INJUNCTION retraining the Defendant/Respondents from taking steps or giving effect to the Kano State Emirs (appointment and Deposition) (Amendment) Law, 2019 (1440 AH) pending the hearing and determination of the Motion on Notice
  4. AN ORDER OF INTERIM INJUNCTION retraining the 4th Defendant/Respondents from appointing or recognizing any purported Emir under the Kano State Emirs (appointment and Deposition) (Amendment) Law, 2019 (1440 AH) pending the hearing and determination of the Motion on Notice
  5. AN ORDER OF INTERIM INJUNCTION retraining the 4th Defendant/Respondents from giving a staff of office or appointing anyone whatsoever as emir of Gaya Emirate, Bichi Emirate, Rano Emirate and Karaye Emirate pending the hearing and determination of the Motion on Notice
  6. AND SUCH FURTHER ORDER OR ORDERS that this Honorable Court may deem just to make in the circumstances.

Upon reading the Affidavit in support deposed to by one Ayo Iliya (Mrs), a litigation secretary in the Law Firm of Diko and Mahmoud and after hearing Suraj Sa’eda (SAN) with Aminu Sani Gadanaya, Ismail Abdulaziz, Sagir Suleman Gezawa, and Oseni Sefullahi for the Plaintiff/Applicant, the court granted all the reliefs in the Motion Exparte.

The Emirates are to be situated in Rano, Gaya, Karaya, and Bichi.
