*Court Declines Request To Grant An Interim Injunction

The Anambra State High Court, Anaocha Judicial Division, Neni, has ordered that status quo be maintained until the Motion on Notice (Motion No.NN/9M/2021) is determined on the 26th of January 2021, in a suit against the Caretaker Committee appointed in Agulu.
His Lordship, Justice G.C Anulude made the pronouncement consequent upon the application filed by Chief Alexander Ejesieme, SAN in suit no: NN/5/2021.
The Court also granted leave to the plaintiff to serve the Writ of Summons, every other accompanying processes and all other subsequent processes on the defendant by substituted means, by posting them at their entrance gates.
However, the Court refused the order being sought by the Applicants for an interim injunction against the Caretaker Committee.
“That an order of interim injunction is hereby refused”, the Court ruled.
In a chat with Chief Alexander Ejesieme, SAN, the learned silk noted that the Court ordered that the parties should maintain status quo and that leave was granted for the adverse parties to be served vide substituted means by pasting the Court processes on their various gates.
In addition, he added that the Court adjourned till 26th day of January, 2021 for the hearing of interlocutory injunction that was filed.
TheNigeriaLawyer recalls that controversies had earlier trailed the decision of the Anambra State Government, annulling the Union’s election that was held on 30th day of December, 2020.
Anambra State Government had also suspended the executive of Agulu and replaced it with a 27-Man Caretaker Committee, alleging that there were disputes over proper delegates accreditation; documented eruption of violence marred the proceedings and that Government observers could not discharge their functions.
Meanwhile, the decision of the Anambra State Government had been greeted with controversies, leading to the present law suit.
