The former 2nd Vice-President of the Nigerian Bar Association (NBA), Monday Ubani, the current Publicity Secretary of the NBA Kunle Edun, John Aikpokpo Martins, former Chairman, NBA Warri, Anne Martins and Emmanuel Ewere have instituted an action before the Federal High Court, Abuja Division, via seeking “the judicial determination of the constitutionality/validity of the removal of democratically elected Local Government Chairmen and councilors and replacing them with Local Government Caretaker or Transitional Committees by state governments in clear violation of the provisions of sections 1(1), 7(1) and 15(5) of the constitution of the Federal Republic of Nigeria, 1999 as amended and extant decisions of the Supreme Court of Nigeria.”

The Originating Summons was settled by Femi Falana, SAN, Ebun-Olu Adegboruwa, SAN,. Desmond Yamah, Esq and Ikhida Ehighelua, Esq.

Defendants in the suit are: Attorneys-General of the Federation, Oyo State, Kogi, Abia, Ondo, Anambra, Imo, Benue, Cross River, Ogun, Borno, Yobe, Kwara, Bauchi, Taraba and Enugu States. Others are The Federal Revenue Allocation, Account and Fiscal Commission, Inspector General of Police, Nigerian Financial Intelligence Unit (NFIU), Federal Minister, Minister of Finance, and Accountant General of the Federation.

The Originating process which was made available to TheNigeriaLawyer (TNL) shows that Affidavit of Non-Multiplicity of action required by the new Federal High Court Rules has been filed. It was deposed to by one Martha C. Eze, a counsel in the law firm of Messrs U. M. Yamah & Co. assuring the court that Plaintiffs have not filed suit elsewhere on the same facts.
