The case against Mrs. Nkem Mba, the Deputy Chief Registrar of the Federal High Court, Awka Division, could not proceed on the last adjourned date (29th September, 2022) due to the absence of the Prosecuting Counsel, Dr. Agada Akogwu.
When the case marked SUIT NO. PHC/2109/CR/2022, BETWEEN: FRN V. MRS. NKEM MBA, was called up,, The learned Senior Advocate, S. A. Somiari, SAN, representing the Defendant, who was present in court informed the court of the Defendant’s pending Motion of ‘No Case Submission’ filed since 9th August, 2022, which ordinarily would have been moved on that day but for the absence of the Prosecuting Counsel.
The Prosecuting Counsel, however, filed an Application for adjournment on 26th September, 2022 to the effect that he would not be available in court on 29th September, 2022 due to a Seminar he was to attend and proposed that the matter be adjourned till 2nd November, 2022.
This application was opposed by the Defendant’s Counsel citing that the proposed date is unreasonably far calculated at further unfairly delaying the matter to the detriment of the Defendant.
Thereafter, he applied that the matter be accommodated in October for fairness to both parties.
Consequently, the matter was adjourned till 12th October, 2022 for Defence, whereupon the learned Silk, S. A. Somiari, SAN undertook to write the Prosecuting Counsel to inform him of the new date.
