The Edo State House of Assembly, and its Speaker, Francis Okiye, on Thursday, withdrew the suit they filed to stop the moves by the National Assembly to take over the state assembly’s functions.

This came barely two weeks after Justice Taiwo Taiwo of the Federal High Court in Abuja made an order restraining the National Assembly from going ahead with the takeover plan pending the hearing and determination of the suit.

The judge had fixed Thursday for hearing of the suit in which the Clerk of the National Assembly, Mohammed Sani-Omolori, and the National Assembly, were joined as the respondents.

But at the resumed hearing on Thursday, the plaintiffs’ lawyer, Mr Sylvanus Ugwu from the law firm of the lead counsel, Ola Olanipekun (SAN), told the judge that his clients had instructed him to withdraw the case.

The respondents’ lawyer, Henrietta Emedem, did not oppose the application, but asked for cost to be awarded against the plaintiffs and in favour of her clients.

The judge, acceding to the plaintiffs lawyer’s request, struck out the case but refused to award cost.
