Dr. Attaihir is challenging some documents ‎presented by Barrister Soba who is the 1st respondent in the case during his contest into the Federal House of Representatives representing Soba Federal constituency, an election he won. In his ruling, Justice Emeka Nwite‎ after listening to augments from counsels to the plaintiff and 1st defendant adjourned till case till the 13th March, 2017 for continuation of hearing on the case. Speaking on the matter, counsel to the 1st respondent, Sulaiman Shuaibu said, “We commenced our defence today and in the course of the trial, the 1st defendant who is Barrister Mohammed Musa Soba started giving his evidence, in fact, his evidence is already before the court. We sought to tender three different documents, one is his affidavit of loss of his letter of termination, the second one is the election petition tribunal in which he was sued by Barrister Ibrahim Soba, which he won at the appeal and the judgment of the appeal court was also sought to be tendered.” He added, “The judgment of the appeal court was tendered unopposed, the affidavit was also admitted unopposed but the only grouse they raise was in respect to the election petition tribunal judgment is with regards to non-exhibition of payment receipt for the certification. This is the bases of the arguments today and the court decided to adjourn till the 13thMarch, 2017 for continuation on the matter.” Commenting on if his client is going to get the certification, he said, “We have already joined issues and it is now for the court to say if the document is admissible or not.” Meanwhile, counsels to the plaintiff,‎ Tajudeen Oladoja Esq and Elisha Kurah SAN, objected one of the documents tendered as exhibit in respect to the election petition tribunal judgment with reagrds to non-exhibition of payment of receipt for the certification.]]>
