Rivers State Government has on 20th day of May, 2020 approached the Federal High Court, Abuja Judicial Division, before Justice Ahmed Mohammed against the Federal Government of Nigeria, urging the Court to declare as illegal and unconstitutional the funding of Police Trust Fund from the Federation Account.

It would be recalled that at the April, 2020 meeting of the Federation Account Allocation Committee (FAAC), it was resolved that on the strength of Sections 4(1) (a) & (b) of the Nigeria Police Trust Fund (Establishment) Act, 2019, the Act justifies the deduction of 0.5 % of the total amount standing to the credit of the Federation in the Federation Account to be remitted to the Nigeria Police Trust Fund.
However, peeved by this development, the Attorney General of Rivers State has dragged the Federal Government to Court on the firm contention that since the Police is an agency of the Federal Government, it is illegal to hold the States of the Federation ransom in order to collectively fund an agency which is not their responsibility from the Federation Account, where the Federal Government is just a mere trustee.
In this light, the Rivers State Government prayed the Court to strike down as illegal and unconstitutional the provisions of the Act:
“permitting the direct deduction of any sum or percentage of revenue accruing to the Federation Account or which ought to have been paid into the Federation Account for the purpose of providing funds for the Nigeria Police Trust Fund”
Mr. Joseph Daudu, SAN led a team of 14 Senior Advocates of Nigeria and some other lawyers on behalf of the Rivers State Government. Meanwhile, the counsel to Ministry of Finance was led by Chinedu Achumie. Mr. Tijani Gazali led the team that represented the Attorney General of the Federation while N. O. Ibom,Esq., led the team that represented the Accountant-General of the Federation. Meanwhile, RMAFC although in receipt of the Court processes was not legally represented on Thursday.
Justice Mohammed however adjourned till 2nd day of July, 2020 for hearing.
