The Nigerian Bar Association Remuneration Committee has reiterated that while legal practitioners may, in deserving cases, charge reduced fees or render legal services without charge, such arrangements must strictly comply with the laws regulating lawyers’ remuneration.

The Committee, in a statement, drew attention to Rule 52(2) of the Rules of Professional Conduct for Legal Practitioners 2023, which permits a lawyer to charge a reduced fee or no fee where there is a special relationship with the client or where the client is indigent.

It, however, stressed that these exceptions do not exempt lawyers from complying with the Legal Practitioners’ Remuneration Order 2023.

According to the Committee, the legal profession must continue to balance access to justice with adherence to professional standards, noting that compassion, generosity and pro bono service must operate within the framework of established rules and ethical obligations.

The Committee said compliance with the Remuneration Order remains essential to preserving the dignity, integrity and sustainability of legal practice in Nigeria.

Chairman of the NBA Remuneration Committee, Chief Akajiugo Emeka Obegolu, SAN, urged legal practitioners to remain guided by the principles of professional responsibility, ethical conduct and compliance when providing legal services to clients, particularly in matters involving reduced or pro bono fees.

He noted that while lawyers have a duty to support access to justice, such support must not undermine the regulatory framework put in place to protect the profession and ensure fair remuneration for legal services.

The Committee reaffirmed its commitment to promoting awareness and compliance with the Legal Practitioners’ Remuneration Order 2023 as part of ongoing efforts to strengthen lawyers’ welfare and uphold the highest standards of professional practice.
