A Yola High Court, presided over by Justice Musa Usman, on Tuesday struck out a suit challenging the creation of Funabe Emirate.

Justice Usman dismissed the suit due to the plaintiffs’ failure to prove that the creation of Funabe Emirate, alongside others, by Governor Ahmadu Umaru Fintiri complied with the law passed by the Adamawa State House of Assembly.

The judge noted that the plaintiffs had neither filed nor served the defendants with a pre-action notice of one month before instituting the action, and no evidence was provided to show otherwise.

He further declared that “the plaintiffs lack locus standi to institute the suit,” stating that they brought the case in their personal capacities rather than as representatives of the Fulbe in Adamawa Emirate.

In suit number HC/ADSY/14/2025, the plaintiffs—Alhaji Musa Halilu Ahmed (Dujima Adamawa), Alhaji Mustapha Dahiru (Yerima Adamawa), and Alhaji Mustapha Ahmadu (Sarkin Noma Adamawa)—contested the creation of Funabe Emirate out of Adamawa Emirate.

The defendants in the case included the Adamawa State Government, Governor Ahmadu Umaru Fintiri, the Attorney General and Commissioner for Justice, and the Emir of Fufore.

The plaintiffs had argued that Governor Fintiri did not follow due process in creating Funabe Emirate and described the creation as illegal.

Chief Leonard Nzadon, who held the brief of Mahmud Magaji (SAN), counsel to the Adamawa State Government and Governor Fintiri, also announced his appearance for the Emir.
