The Osun State Government has approached the State High Court in Osogbo seeking an order compelling the Inspector-General of Police and the Commissioner of Police, Osun State Command, to investigate alleged inciting statements attributed to Senator Francis Fadahunsi in a viral campaign video ahead of the August 15, 2026 governorship election.

The action, filed by the Attorney-General and Commissioner for Justice, Oluwole Jimi-Bada, SAN, on behalf of the state, specifically seeks an Order of Mandamus directing the police authorities to investigate the statements, secure and preserve the electronic evidence, authenticate the video and take necessary preventive measures to safeguard persons allegedly threatened by the remarks.

The suit, dated August 12, 2026, was filed at the Osogbo Division of the Osun State High Court.

The Inspector-General of Police is listed as the first respondent, while the Commissioner of Police, Osun State Command, is the second respondent.

Fadahunsi, who represents Osun East Senatorial District in the National Assembly, is joined in the proceedings as the Person Affected/Interested Party.

According to the court documents, the controversial video allegedly shows Fadahunsi addressing a political gathering in front of the Owa Obokun Palace in Ilesa, where he was alleged to have made statements capable of encouraging violence against members and supporters of the Accord Party.

The state alleges that the remarks included a call on APC supporters to kill Accord Party members wherever they encountered them, as well as alleged threats involving their wives and children.

The application further alleges that Fadahunsi called for Accord Party members to be chased out of hotels and warned that the governorship election would not hold if members of the opposition party resisted APC supporters.

The Attorney-General, however, made it clear in the court processes that the state is not asking the court at this stage to determine whether Fadahunsi is criminally guilty of any offence.

Rather, the government wants the court to compel the police to exercise their statutory investigative and crime-prevention powers in relation to the allegations.

Among the reliefs sought is an order directing the police to obtain the complete and unedited version of the viral video and subject it to authentication and forensic examination.

The state also wants the police to investigate where and when the recording was made, the audience present, the circumstances surrounding the alleged statements, and the identities of persons who sponsored, published, circulated or were otherwise connected with the video.

The court documents state that the video forming the basis of the application was obtained from Facebook on August 11, 2026, by Nurudeen Kareem, Special Adviser to the Osun State Governor on Legal Matters.

Kareem deposed to the affidavit supporting the application and also provided a certificate of compliance relating to the electronic evidence.

Jimi-Bada argued that the police are under a statutory obligation to prevent and detect crime, maintain public order and protect lives and property.

According to the Attorney-General, the alleged statements, if authenticated after investigation, could amount to serious criminal conduct and pose a threat to peace and security during the governorship election.

The Osun State Government is therefore also asking the court to compel the police to take preventive measures to protect Accord Party members, supporters, candidates, agents and officials.

The protection sought also extends to voters and other residents who could be endangered by any violence arising from the alleged incitement.

The state further wants the court to direct the police authorities to submit a comprehensive report detailing the steps taken in compliance with the court’s order within 48 hours, or within any other period the court considers appropriate.

In its written address, the government stressed the urgency of the application, arguing that “time is of the absolute essence” because the governorship election is scheduled for Saturday, August 15.

It contended that any delay in investigating the allegations, securing the electronic evidence or taking preventive security measures could expose residents to avoidable danger, including possible loss of life and irreparable harm.

The Attorney-General maintained that the reliefs being sought are preventive rather than punitive and do not amount to an invitation for the court to pronounce Fadahunsi guilty.

The state’s case is consequently focused on compelling the IGP and Osun State Commissioner of Police to investigate the allegations, preserve relevant evidence and perform their statutory duties in the interest of public safety, electoral peace and the rule of law.

Meanwhile, the police have confirmed that Fadahunsi has already been interrogated in connection with the controversial video and that investigation into the matter is ongoing.

Force Public Relations Officer, CSP Aniete Iniedu Okokon, said this after the senator was questioned at the Osun State Police Command headquarters in Osogbo on Wednesday.

According to the police spokesperson, the outcome of the investigation would be made public when the process is concluded.

He also assured residents that adequate security measures had been put in place to protect voters, electoral officials and other persons participating in Saturday’s election.

Fadahunsi has, however, denied that he called for the physical killing of Accord Party members or their families.

Speaking after his interrogation at the Criminal Investigation Department of the Osun State Police Command, the senator insisted that the viral footage had been edited and presented in a manner that misrepresented what he actually said.

According to Fadahunsi, he was referring to politically defeating or “killing” the Accord Party with votes in the August 15 governorship election rather than physically attacking its members.

The court action therefore places before the Osun State High Court the specific question of whether the police should be compelled by mandamus to fully investigate and forensically examine the disputed video, take preventive security measures and report back on the steps taken, rather than asking the court at this stage to determine the senator’s criminal liability.
