*They Argue That By Rules Of Court, Omirhobo Cannot Appear The Court In Religious Attire
*Court Orders An Adjournment For Omirhobo To File Address On Right To Appear

In the Federal High Court sitting at IKoyi, Lagos, on Monday, 28th June 2022, some lawyers challenged the right of controversial human rights lawyer, Chief Malcolm Omirhobo to appear before the court amidst “unprofessional” dressing.

In a video making rounds, sighted by TheNigeriaLawyer, Malcolm Omirhobo who had been making appearance in Courts at different levels dressed in his religious attire – feathers stuck wig, dowry necklaces and hand beads and leg beads and red wrapper worn underneath his gown – was met with opposition by his learned colleagues who argued that the lawyer had no right to enter appearance before the Court dressed in the manner he was dressed.

A lawyer addressing the Court as an amicus curie on the issue stated that by the rules of Court, Omirhobo had no right to enter appearance. “I am an amicus in this matter, I am interested in addressing the manner my learned colleague is dressed before this Court. I refer my lords to Order 45 and Order 55 of the Rules, he cannot appear before this Court” He said. According to the lawyer, rules that guide the practice of the legal profession are sui generis and do not contradict the Constitution. He expressed the Court to file an address before the Court on the lack of right to appearance by Malcolm Omirhobo.

Another lawyer, addressing the Court as an amicus curie raised another issue before the Court, he argued that Malcolm Omirhobo had no right to address the Court during the Court sitting as he was not properly attired, and that in the next sitting he need get another lawyer to address the court if he is dressed religiously.

Recall that the that same say the court per Justice Ringim had ordered an adjournment for 10th October, 2022 and ordered Omirhobo to file a written address on right to appear on the next adjourned date. This had been the same ruling in two cases marked suit no FHC/CS/939/2022 and FHC/L/CS/1392/2021 before the same Court. And that the address must not be more than five pages citing authorities and filed before the adjourned date after he’s right to appearance had been challenged.

Replying opposition, Malcolm Omirhobo stated that he was armed with authorities and would on the next adjourn date address the court fully on the matter. As regards that he should get the services of another lawyer at the next adjourned date, he said: “I would not. It is my fundamental right. I have been called to bar.”

The Court ordered that Malcolm Omirhobo pick a date to address the Court on his right to appearance and address the Court in his religious attire, and it graciously obliged those that seek to address the court on the issue as amicus curie.
