Olanrewaju Ayodele Ogunlesi, SAN has raised serious allegations against a Judge and some members of the Bar. The allegation as shocking! The allegations are mind-boggling, befuddling, deafening and heart-rendering! If this true, then, It is obvious that the rot in the Bar and the Bench has gone too far and so much evil has gone on for so long in the bench.

There is an urgent need to declare a state of emergency in the legal profession (the Bar and the Bench) See what the senseless, mad and shameless pursuit for money could lead supposed Learned Gentlemen and Hon Judges to put their hands into.

In a counter-affidavit of the Polaris Bank in opposition to the Quadri Lateef, Hamzat Habeeb Olalekan and Rafiu Jeleel oladimeji (Claimants/Applicants) Motion for stay of execution of Judgement, the learned silk alleged that Justice S. O. Falola granted an execution order in favour of the Applicants to the tune of N16, 445,720 (Sixteen Million, Four Hundred and Fourth-Five Thousand, Seven Hundred and Twenty Naira) in respect of a non-existent judgement allegedly obtained since 2015 at Kwara State which has not been registered in Osun State. The learned silk further alleged that Justice S. O. Falola signed the execution warrant before the expiration of three days stated in his ruling and the judgement debtors are not resident in Osun State.

Based on the action of Justice S. O. Falola, execution was levied on the premises of Polaris Bank at four different locations on the same day by the Bailiff and one of the registrars of the court assisted by Mr. J. P. Jones of counsel. Because of his findings the learned silk put a call to one Lukman Ogunsetan, Esq a legal practitioner and a native of Osun State and enquired about Justice S. O. Falola. The lawyer pleaded with the learned silk not to destroy the career of the judge as it would be a disgrace for him to be removed by the NJC having regards to the similar situation that occurred in Lagos State. The lawyer (Ogunsetan) got in touch with Justice S. O. Falola and they (Ogunsetan and Justice S. O. Falola) met the learned silk at his office in Lagos. The learned silk asked the judge why he did what he did and the judge was apologetic.

He pleaded for mercy and said he would change. The judge made other confessions of his opposition to the appointment of Hon. Justice Oyewole now JCA as the Chief Judge of Osun State during the government of Aregbesola, he and the president of the Customary Court of Appeal opposed the coming over of Hon. Justice Oyewole, JCA from Lagos State against the wishes of 20 judges, he opposed the President of the Customary Court of Appeals desire to be the Chief Judge of Osun State since she was merely married to an indigene of Osun State. He revealed that similar matter was in his friend’s court he will advise him to strike out the matter. Eventually, Justice S. O. Falola undertook to pay the money and up till date he hasn’t paid the money.

Ogunlesi, SAN dares Justice S. O. Falola and Jones as well as the deponent to deny the above facts, and he will have no other option than to release more information that will careers. The learned silk gives his words not to do so if and only if Justice S. O. Falola pays the entire sum collected from the Polaris Bank and O. O. Odusola the sum of 1 million Naira awarded by the Court. That he has telephoned the Chief Judge of the state when she was in Canada on vacation to express his displeasure over the situation and she promised to get back to him immediately she comes back.

That further to the above facts, Justice S. O. Falola prostrated and thank him for his assurance not to report him to the NJC. The learned silk said in his entire years at the bar, he has never seen a judge prostrate for a counsel in a matter he had dealt with.
