The National Judicial Council (NJC) has dismissed a petition filed against Honourable Justice Emeka Nwite of the Federal High Court, Abuja, by a group of lawyers under the aegis of Ekiti Lawyers Vanguard for Transparency.

The lawyers, representing 54 members of the Vanguard, had accused Justice Nwite of bias and desecration of the hallowed temple of justice, alleging that his actions could bring Nigeria into disrepute if not curbed.
In a reply issued by its secretary, Ahmed Gambo Saleh, on behalf of the Chief Justice of Nigeria (CJN), the NJC stated that the group failed to include a verifying affidavit as required by the Judicial Discipline Regulations 2017. The Council emphasized that without the verifying affidavit, the petition could not be treated in accordance with the provisions of Regulation 14 (5) of the extant Judicial Discipline Regulations 2017.
The petitioners, including Ademiloye Oladotun, Balogun Adeyemi, Fadeshola Alice, Ola-Ojo Samuel, Olayinka Ibrahim, Adebayo Joel, Akintoye Bayonle, Ogundare Kayode, Adaramola Olakunle, and Igandan Olawunmi, had accused Justice Nwite of various misconduct and controversies. However, their petition was deemed incomplete due to the absence of the necessary verifying affidavit.
The NJC’s decision to dismiss the petition highlights the importance of adhering to the proper procedures and regulations when filing complaints against judicial officers. The Judicial Discipline Regulations 2017 serve as a guideline to ensure that allegations against judges are properly substantiated and investigated, maintaining the integrity of the judiciary.
The dismissal of the petition does not necessarily exonerate Justice Nwite from the allegations made against him but rather emphasizes the need for petitioners to follow the correct legal procedures when seeking redress or raising concerns about the conduct of judicial officers.
