TheNigerialawyer, Chief Johnson Anumudu disclosed that the NBA has failed to determine the outcome of the petition after it was forwarded to it on the said date. TheNigerialawyer recalls that Chief Johnson Anumudu, on the 20th day of June, 2017 forwarded a petition against Mr. Norrison Quakers (SAN) alleging that the learned silk used Hon Justice Oluyemi L.A.Y (Mrs) of Lagos State High Court Lagos to obtain unlawful and illegal court orders to destroy No 9b Adeola Odeku Street Victoria Island Lagos, a property in lawful possession of his client, Bright Motors Limited. In the petition filed, Chief Johnson Anumudu claimed that on the 30th August, 2012, he filed a Writ of Summons – LD/1341/2012 on behalf of Bright Motors Limited against one Muhammed Sanusi Dagash and another as defendants in the Court of Hon. Justice Oyekan Abdulahi of the High Court of Lagos State Holden at Lagos. Also he filed a Motion on Notice dated the 22nd August, 2012 praying the Honourable Court for an Order of Interlocutory Injunction restraining the Senator Muhammed Sanusi Dagash and their agents and/or servants from ejecting Bright Motors Limited and its tenants forcefully from the premises and Senator Muhammed Sanusi Dagash was duly served with the said Motion on notice and the Writ of Summons through his Counsel Mr. Norrison Quarkers (SAN). However, on the 11th day of March, 2013 at about 12.00 noon, he was about to move a Motion for Interlocutory Injunction at the instance of the Honourable Justice Oyekan-Abdullahi after satisfying herself that the Respondent in that matter had been served, when Mr. Norrison Quarkers SAN stood up and informed the Court that he had written a letter dated 4th March, 2013 to the Honourable Chief Judge of Lagos State for the suit to be transferred to the Honourable Justice L.A.Y. OLUYEMI’s Court to be Consolidated with a “sister case” which they instituted against the estate of Chief Francis Ijeiwere and others, in Suit No: M/1171/2012 .  He stated that the suit was later adjourned and transferred to be consolidated but Bright Motors Limited was never notified by the Registrar of Justice Oluyemi’s Court that Suit No: LD/1341/2012 had been transferred to their Court and they were equally not served with processes. According to him, he called Mr. Norrison Quarkers SAN severally to find out the outcome of the application to the Honourable Chief Judge but on each occasion, Mr. Quarkers assured him that the outcome would be communicated to him as soon as he got same and that he would file a Motion for the Consolidation of the two matters which would be served on his client accordingly. And that on Friday, the 17th day of May, 2013, he received a letter from the office of the Honourable Chief Judge dated 14th May, 2013 informing him that their Suit before Justice Oyekan-Abdullahi (LD/1341/2012) has been Consolidated with the suit pending in Justice Oluyemi’s Court. When the letter was received he put a call across to Norrison Quarkers SAN who agreed with him that it was a mistake by the author of the said letter from the office of the Honourable Chief judge that the two matters had been consolidated. Mr. Quarkers then assured him that he was preparing a Motion for the Consolidation of the two matters which would be served on him. According to him, they were neither served with any application to consolidate the two suits as promised by Mr. Norrison Quakers nor a Hearing notice from the Honourable Court informing them of any date for the two or any of the matters but were surprised when on the 5th day of June, 2013 two Sheriffs, other Officers of the Lagos High Court and Police men all numbering about 50 (Fifty) invaded Bright Motors Limited premises at No: 9B, Adeolu Odeku Street, Victoria Island, Lagos the subject matter of the two suits to execute an Order/Ruling delivered by Honourable Justice L.A.Y. OLUYEMI on Monday, 20th May, 2013 just 3 (Three) days after he received the letter from the Honourable Chief Judge and after Mr. Norrison Quakers SAN in a telephone conversation assured him that he would bring a Motion for the Consolidation of the two matters. In the letter sent to TheNigerialawyer, Chief Johnson Anumudu stated that after the Chief Judge obliged and transferred suit no. LD/1341/2012 to the court of Hon. Justice Oluyemi L.A.Y (Mrs), Mr. Quakers, failed to apply for the two suits to be consolidated and that apart from failing to comply with the undertaking to the Chief Judge of Lagos State, Mr. Quakers, in his counter affidavit sworn to at the High Court Lagos Registry on 10th January 2014 DENIED he ever undertook to bring an application to consolidate the two suits, thereby committing PERJURY. He therefore submitted that Mr. Norrison Quakers (San) breached Rule 31(3) of the Rules of Professional conduct for legal practitioners 2007 and filed a petition to that effect. He noted that the petition was forwarded to the Nigerian Bar Association (NBA) Secretariat, Abuja who acknowledged receipt through its letter to him dated the July 5th, 2017 and that the NBA claimed it forwarded the petition to Mr. Norrison Ibinabo Quakers as soon as it received the petition but till date, the NBA has failed to determine the outcome of my petition.
