-Says Notice, On Amendment, Falls Short Of Constitutional Requirement

A former NBA Secretary General, Hon. Nimi Walson-jack has faulted the proposed amendment to the NBA Constitution for failing to meet the constitutionally required time for notice- 30 days, required for any such process; and also on the authority of the Assistant Secretary General to issue the Notice.

Walson-jack disclosed in a statement made available to TheNigerialawyer, dated Friday, the 29th of July, 2020; and titled RE: NOTICE OF AMENDMENT TO THE CONSTITUTION OF THE NIGERIAN BAR ASSOCIATION (2015) OBJECTION TO NOTICES OF AMENDMENTS.

The 2004-2006 NBA Secretary-General noted that neither of the notices circulated by the Secretary-General and Assistant Secretary fulfilled the stipulated time of 30 required for such a process of amendment.

Jack also faulted the notice as circulated by the NBA-ASG, suggesting that the office of the ASG does not have the power to sign, or issue such a circular especially as it wasn’t indicated that it was from the  Office of the Secretary; who he believes is the only competent authority for such.

The former NBA Secretary-General faulted the supposed ‘countermand clause in the notice as issued by the Assistant Secretary-General suggesting superiority over previous Notices.

Recall that sources within the NBA leadership have earlier hinted of a cold in-house war ongoing at the NBA secretariat over the proposed amendment of the NBA Constitution as the NBA Secretary-General has insisted that the time allowed by the NBA Constitution has elapsed as such, the amendment process may no longer be constitutional with the upcoming NBA AGM less than the required 30 days from the time the letter was written.

Constitutional amendment is a matter for the AGM. If the Meeting is dissatisfied with the steps taken by any of the players then it can abort the entire process, TheNigerialawyer reports.

The former NBA Secretary-General faulted the supposed ‘countermand clause in the notice as issued by the Assistant Secretary-General suggesting superiority over previous Notices.

However, the TheNigeriaLawyer as part of a detailed investigation into the situation found out that the Constitutional amendment is a matter for the AGM, hence if the Meeting is dissatisfied with the steps taken by any of the players then it can abort the entire process.

What remains clear is that the issues surrounding the amendment of the NBA Constitution are far from over even as we approach the 2022 NBA AGM billed for August.
