*Says No Legal Right Shown

The High Court of Lagos State has refused the application filed by Mr. Adesina Ogunlana seeking to be re-instated as a presidential candidate in the forthcoming NBA National Elections.

Meanwhile, at the hearing today, the matter was initially stood down till 1 pm for hearing in order to enable parties to complete the filing of all their processes.

Besides, the Court indicated that any party unable to complete the filing by 1 pm would be given the opportunity to canvass oral arguments in lieu thereof. This is because the Judge was willing to hear and determine the matter because of the urgency.

However, the matter was recalled at 1 pm by which time all the processes had been filed.

Meanwhile, the application was greeted by a preliminary objection filed by Agweh, SAN, and Ananaba, SAN equally filed his preliminary objection and counter- affidavit to the Motion for interlocutory injunction.

In addition, the preliminary objections to the application for an interlocutory injunction as well as the application were heard together by the Court.

Besides, the Judge initially wanted to adjourn to Monday for a ruling but in view of the closure of 3rd Mainland Bridge as from midnight today which was brought to her Lordship’s attention, she accepted to write a Bench Ruling in open Court.

After hearing both parties, the Court delivered its Ruling refusing the preliminary objections filed.

Furthermore, the substantive application for interlocutory injunction was dismissed on the basis that no legal right was established by the applicant.

It was stated that his application cannot be countenanced for having failed to forward a letter of good standing as contained in the ECNBA Form 01. Also, it was held that his right to contest is inchoate since he did not comply with the conditions precedent.

Meanwhile, Dr Paul Ananaba SAN represented the Trustees, Rotimi Seriki represented NBA Prez & GS while Samuel Agweh SAN represented ECNBA Chairman & Secretary.
