The Nasarawa State Judiciary has issued a circular prohibiting all lower courts from issuing bank orders with immediate effect.

The directive, signed by Yahaya Yakubu Shafa, the Executive Secretary of the Judicial Service Commission, aims to prevent further abuse of power by the lower courts.

According to the circular dated February 13, 2025, the Chief Judge and Chairman of the Judicial Service Commission has directed that all lower courts are prohibited from issuing orders freezing bank accounts, directing banks to pay funds, or requiring banks to provide financial information. Henceforth, all applications for bank orders must be made to the High Court only.

The circular emphasizes that this prohibition does not affect the power of lower courts to issue other types of orders for the administration of justice. All lower courts are required to comply with this directive and ensure that all relevant personnel are informed and guided accordingly. Failure to adhere to this directive shall constitute gross misconduct punishable with dismissal.

The move comes as a response to concerns raised about the abuse of power by some lower courts in issuing bank orders, which has led to inconsistencies and unfairness in the administration of justice.

The Nasarawa State Judiciary believes that this directive will help to promote transparency, accountability, and public confidence in the judicial system.
