The Federal High Court in Abuja on Thursday convicted Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra (IPOB), on all seven terrorism-related charges brought against him by the Federal Government.

Justice James Omotosho, while delivering judgment, found Kanu guilty of engaging in acts of terrorism, leading a proscribed organisation, issuing threats, inciting the killing of security personnel, committing international terrorism, and importing an unregistered radio transmitter.

The court held that Kanu knowingly committed acts of terrorism through broadcasts that threatened widespread death and disruption, and that he acted without consideration for the safety of citizens.

Breakdown of Convictions:

  • Count 1 – Committing Acts of Terrorism: The court ruled that Kanu engaged in preparatory acts of terrorism, using broadcasts to threaten death and widespread disruption. Justice Omotosho stated, “Mr Kanu knew what he was doing; he was bent on carrying out these threats without consideration to his own people.”
  • Count 2 – Threats to Enforce Sit-at-Home Orders: Kanu was found guilty of threatening individuals who did not comply with enforced sit-at-home orders in the South-East. The court described the actions as unconstitutional and a terrorist act that violated citizens’ rights.
  • Count 3 – Belonging to a Proscribed Organisation: Evidence showed Kanu not only belonged to IPOB, a proscribed group, but also led it. He admitted membership in multiple broadcasts and was linked to the Eastern Security Network (ESN), the group’s armed wing. Justice Omotosho referenced Section 122 of the Evidence Act and a prior ruling by Justice Binta Nyako declaring IPOB illegal and terrorist.
  • Counts 4 & 5 – Inciting the Killing of Security Personnel: Kanu incited attacks on police and military officers, contributing to the deaths of over 128 police officers, 37 military personnel, and 10 other security officials. The court also cited arson attacks on INEC offices and police stations, including incidents connected to the ENDSARS protests. Justice Omotosho said Kanu had “turned himself into a tyrant.”
  • Count 6 – International Terrorism: The court found that Kanu directed IPOB members to manufacture bombs and explosives for both domestic and international targets. He broadcast calls for chemical engineering graduates to produce Molotov cocktails. The court held that his intentions to attack the American Embassy and assassinate former British High Commissioner Catriona Laing classified him as an international terrorist.
  • Count 7 – Importation of Undeclared Radio Transmitter: Kanu was convicted for importing a concealed radio transmitter in a container of used household items, violating Section 47 of the Customs and Excise Management Act. Radio Biafra, which used the transmitter for broadcasts, was not registered with the National Broadcasting Commission.

Justice Omotosho concluded that the evidence against Kanu was incontrovertible and that he had acted knowingly and deliberately in committing all the offences.

The court noted that Kanu failed to provide a credible defense and “deliberately refused” to counter the evidence presented by the government.
