A group of independent legal practitioners under the aegis of Fiat Justitia has announced plans to institute coordinated legal actions against the Federal Government, the South-East Governors’ Forum, the Nigerian Army, Nigeria Police Force and State Security Service, SSS, over the alleged disappearance, prolonged detention and abduction of residents of the South-East.

The lawyers said they had compiled a list of 80 persons allegedly missing, abducted or presumed dead and had assembled affidavits, photographs, medical records and testimonies from relatives and survivors in preparation for court proceedings.

Speaking at a press briefing at the Correspondents Chapel in Umuahia on Monday, a representative of the group, Adekoye Segun, said Fiat Justitia was acting on behalf of families seeking information about relatives who allegedly disappeared following arrests or security operations across the region.

Segun alleged that several persons arrested on suspicion of membership of the Indigenous People of Biafra, IPOB, had neither been produced before courts for trial nor released to their families.

He said the proposed legal proceedings would seek to compel government authorities and security agencies to account for every person on the group’s list whose whereabouts remain unknown.

“We are preparing a coordinated legal action and accountability proceeding against the following: The South-East Governors’ Forum, the Federal Government of Nigeria, the Nigerian Army, the Nigerian Police Force, the Department of State Services.

“We will demand that they account for every missing person in the South-East,” Segun said.

The lawyer further alleged that some civilians arrested in the South-East were transferred to military detention facilities outside the region, including Wawa in Niger State, where they were allegedly held for prolonged periods without being properly brought before civilian courts.

He said the contemplated action would require the relevant authorities to explain under oath the circumstances surrounding such transfers and continued detention.

“We will demand that they explain under oath why citizens arrested in the South-East are being transported to military detention centres in distant locations such as Wawa, Niger State, and held for prolonged periods without being properly brought before competent civilian courts,” he said.

The allegations concerning detainees being transferred to Wawa are not entirely new. In October 2022, TheNigeriaLawyer reported allegations by relatives and lawyers that at least 24 persons were unaccounted for after arrests by security agencies, with some allegedly transferred to Wawa Military Barracks in Niger State.

That earlier report included allegations involving persons arrested while returning from proceedings in the trial of IPOB leader Nnamdi Kanu, as well as other individuals allegedly apprehended during security operations in the South-East.

Fiat Justitia’s latest intervention, however, expands the scope of the allegations, with the group saying it is now acting for families connected to 80 persons allegedly missing, abducted or presumed dead.

Segun referenced persons allegedly affected during security operations and violent incidents in Aba, Umuahia, Nkpor and other locations in the South-East.

Among the incidents mentioned by the group was Operation Python Dance in Umuahia, with the lawyers alleging that some persons affected by security raids and confrontations during the period have still not been accounted for by the relevant authorities.

The group said its evidence includes sworn affidavits from relatives, photographs, documented testimonies and medical reports which it intends to place before the courts.

It stressed that the allegations would ultimately have to be tested through legal proceedings and that its immediate objective was to compel public authorities to provide answers about the whereabouts and legal status of the persons concerned.

Segun also called for the immediate prosecution or release of persons whom the group alleges have remained in detention for periods ranging between four and eight years without trial.

The lawyers maintained that persons suspected of committing criminal offences should be brought before competent courts rather than kept in indefinite detention.

Fiat Justitia said its contemplated litigation would seek accountability not only from federal security agencies but also from the South-East Governors’ Forum over what it described as unresolved disappearances and detentions within the region.

The group said families of the affected persons were entitled to know whether their relatives remained in official custody, had been transferred elsewhere, had been released or had died.

The allegations against the Federal Government, governors and security agencies have not been judicially determined, and no court has yet established responsibility for the individual cases identified by Fiat Justitia.
