In an Open letter addressed to the Honourable Chief Judge of Cross River State, Daniel K. Kip, a lawyer based in Calabar, has called for the implementation and enforcement of the Rent Control and Recovery of Premises Law in the state.

Kip highlighted the challenges faced by tenants in the state, including arbitrary rent increases, poor living conditions, and exploitation by some unscrupulous landlords. He emphasized the need for effective regulation of tenancy rentage to protect vulnerable tenants, such as low-income earners and students.

The lawyer cited the Rent Control and Recovery of Premises Law, which subjects rent chargeable for residential accommodation in Cross River State to the maximum prescribed in the Schedule to the Law. He also highlighted Section 2 (1) of the Law, which mandates the Governor, on the recommendation of the Chief Judge, to divide the state into zones for the purpose of rent control and establishing Rent Control Courts.

Kip called on the Cross River State House of Assembly to amend the law to align with current realities and urged the Chief Judge to exercise the powers enshrined in the law to set up the necessary legal and administrative framework for its implementation.

The lawyer argued that activating the Rent Control Law would promote stability and predictability in the rental market by providing clear guidelines on rentage and increments. He also noted that the law would encourage landlords to maintain their properties and provide basic amenities to meet certain rental values, thereby ensuring better living conditions for tenants.

Kip emphasized that by regulating tenancy rentage, Cross River State can foster a fair, stable, and predictable rental market that protects the rights of both tenants and landlords.
