In the case with the Suit NO: FHC/AWK/113/2017 has Attorney General and Minister of Justice Federal Republic of Nigeria and Nigerian Christian Pilgrims Commission (NCPC) as the Respondent. In Plaintiff in his suit is arguing that The Nigerian Christian Pilgrims Commission (NCPC) is the statutory body with perpetual succession charged with the task of facilitating pilgrimages to the Christian Holy Land by Christian Faithful and that Section 2 of the Nigerian Christian Pilgrim Commission Act 2007 designate the following as amongst members of the Commission who are public servants to wit- A representative of the Ministry of Aviation, Foreign Affairs, Internal Affairs, Finance and Health inclusive of representative from the Central Bank of Nigeria. He also stated that Sections 7,9 and 10 of the Act provides for appointment of Secretary of the Commission and who shall be paid emoluments and otherwise the National Income, Salaries and Wages Commission may decide. Service at the Commission is pensionable. Section 3(d)-(I) of the Act provides that the Commission shall provide accommodation, transportation, establish and manage camp in addition to related welfare, services and equipment for Christian Pilgrims. Section 16 of the Act provides that not only shall State Governments willy-nilly contribute funds to the NCPC but also that the latter could go on to claim and have the FG set off any unpaid charge as a first line charge against the revenue accruable to any state of the Federation which fails to surrender public funds under her custody to NCPC, so that a handful of Christian faithful (Pilgrims) could fulfil their personal religious obligations. the Plaintiff is seeking that provisions of Section 10 of the 1999 Constitution (as amended) prohibits state religion and forbids the State from expending public funds in the aid, support and /or sponsorship of any religion and /or its adherents and that the provisions of the NCPC Act stated above is unconstitutional and against the provisions of Section 10 of the 1999 Constitution (as amended). He is also asking the Court to compel the FG to withdraw everyone in the employ of any government or government agency or department from the NCPC and decline from remunerating them from public coffers. And to Perpetual restrain the FG from sponsorship of Pilgrims and activities of NCPC. The suit is fixed for 6th December for hearing ]]>
