Senior Advocate of Nigeria (SAN) Kunle Edun has strongly criticized the arrest of human rights lawyer Dele Farotimi by the Nigerian Police Force over allegations of criminal defamation.
In a statement, Edun described the arrest as a “gross abuse of power” and emphasized that criminal defamation is no longer recognized as an offence under Nigerian law.
“Defamation is a civil matter, and anyone aggrieved should seek remedies through civil litigation, not by employing security agencies as tools of harassment,” Edun asserted.
He highlighted that the appellate court has declared criminal defamation unconstitutional, adding that the police’s action violates the constitutional right to freedom of speech.
Edun expressed concern over the recurring use of state power by affluent individuals and politicians to suppress dissenting voices. He described this practice as a “betrayal of public trust” and an unconstitutional exercise of privilege.
“The powers given to security agencies are held in trust for the public and must not be used to serve private interests or settle personal grievances,” Edun stated.
Calling for immediate action, Edun urged the Inspector General of Police to direct the release of Farotimi and focus law enforcement efforts on tackling significant issues, such as the looting of public funds and corruption in government.
“The police should stop de-marketing itself by being used as an oppressive tool against citizens. Bigger criminals in power who mismanage our commonwealth should be the priority,” Edun concluded.
The arrest of Farotimi has drawn widespread criticism from civil society groups and legal practitioners, who see it as part of a larger pattern of attempts to stifle freedom of expression in Nigeria.
