The court said it was important for parties to maintain status quo in the interest of justice on the suit which was instituted by the immediate past governor of the state, Captain Idris Wada. The presiding judge, Justice Henry Olusuyi, gave the order following an issue raised by counsel to the former governor, Chief Chris Uche SAN, to the effect that the commission was still sitting after the order of the court on status quo given at the last hearing date of the suit. Apart from this, the court has also adjourned sitting till January 16, 2017 for hearing on the motion on notice and preliminary objection brought by the state governor, Alhaji Yahaya Bello. Olusuyi had on December 6 when the issue came up for hearing told the parties to maintain status quo pending the determination of the substantive suit. But Uche told the court that the commission did not obey the order of the court as it had invited some commissioners that served under Wada to appear before it after the last sitting of the court. He urged the court and parties to take steps that would not further jeopardise proceedings in the interest of justice. Counsel to the governor, who is also the Attorney-General of the state, Mohammed Ibrahim, had sought the leave of the court for an extension of time during which he could file his addresses and other papers. Following the granting of the application by the court, he moved another application for motion on preliminary objection to the suit brought before the court. But Uche noted that the motion was ” a complete ambush” as the motion that was dated December 9 was only served on him in the court on Thursday despite that the matter was adjourned at the instance of the defendants. He therefore prayed the court for time to reply to the issues raised in the motion. The trial judge, while adjourning the case said, “it is also important to stress that parties should maintain status quo in the interest of justice.”]]>
