A barrister has been suspended from practice for 12 months after a disciplinary tribunal found that he knowingly assisted his former solicitor daughter to breach a High Court injunction barring her from exercising a right of audience.

Mohammad Tayyab Khan, who was called to the Bar in 1972, was found by the Bar Tribunals and Adjudication Service to have committed professional misconduct during a pre-inquest hearing before a coroner’s court in June 2022.

The tribunal found six charges of professional misconduct proved against him.

Khan is the father of Soophia Khan, a former solicitor who was, at the time, subject to an injunction granted by the High Court in November 2021.

The injunction, obtained by the Solicitors Regulation Authority and granted by Mr Justice Fancourt, prevented Soophia from exercising a right of audience.

During the pre-inquest hearing, Khan appeared as advocate for the family of the deceased and was accompanied by his daughter.

The tribunal found that Khan took instructions from Soophia and relayed her responses to the coroner, thereby knowingly assisting her to breach the High Court order.

It was also found that Khan read out replies supplied to him by his daughter in a manner described as disjointed, time-consuming and disruptive to the efficient conduct of the inquest.

The tribunal further held that Khan lacked integrity, wasted the court’s time and behaved in a way likely to diminish public trust and confidence in the profession.

He was also found to have made an inaccurate statement to the coroner about records held by the Bar Standards Board in relation to his professional status.

Reacting to the decision, a spokesperson for the BSB said barristers have a duty to assist the court and support the administration of justice.

“Barristers have a duty to assist the court and support the administration of justice. Mr Khan’s conduct fell below the standards expected to comply with this. The tribunal considered all the matters carefully and the sanction reflects the seriousness of his actions,” the spokesperson said.

The tribunal consequently imposed a 12-month suspension on Khan.
