The suit among other reliefs, is aimed at striking out the provisions of section 23A(1)(b), (2)&(3) inserted in the legal practitioners’ act (as amended) by section 12 of the legal practitioners’ amendment decree No. 21, 1993, for being unconstitutional, null & void & of no effect. The provisions of the said section confer immunity on the Body of Benchers as no legal proceedings can be instituted against it or any of its committees & such act is even an offence punishable with fine and or 1 year imprisonment. The application is supported by a seventeen paragraph affidavit deposed to by the applicant, HAMEED AJIBOLA JIMOH ESQ. challenging the immunity of the distinguished body of benchers to be unconstitutional and to be declared null and void, the learned counsel is of the opinion that the provision of the Law in contention is a threat to the fundamental rights of the citizens enshrined in the constitution as one cannot seek relief against the body if it violates any of the citizen’s right enshrined in Chapter IV of the Constitution. Although the suit is yet to be assigned to a judge, it is certain that the an interpretation on the above provision will bring to a stop the controversy surrounding the said provision of immunity.
