The Chief Judge of the Federal High Court of Nigeria, Honourable Justice John Tsoho, has directed prominent Senior Advocate of Nigeria, Mr. Femi Falana, to file a Motion on Notice for his request to reassign a case file from the Abuja division to the Port Harcourt division of the court.

In a letter dated October 25, 2024 and addressed to Mr. Falana, the Special Assistant to the Chief Judge, Joshua Ibrahim Aji, Esq., stated that the application for case reassignment must be made judicially by Motion on Notice. This will allow the presiding Judge the opportunity to review the reasons presented and deliver a ruling on the matter.

The case in question, with suit number FHC/ABJ/CS/984/2024, is between the Rivers State House of Assembly & Anor as the plaintiffs, and the Central Bank of Nigeria & 9 Ors as the defendants. Mr. Falana had written to the Chief Judge on October 25, 2024 requesting that the case file be reassigned from Abuja to a Judge in the Port Harcourt Judicial Division.

The request cited Section 36(1) of the Constitution of the Federal Republic of Nigeria 1999 as amended and Order 49 Rule 2 of the Federal High Court Civil Procedure Rules as grounds for the reassignment. However, the Chief Judge has clarified through his Special Assistant that the proper procedure is for the request to be made via a formal Motion on Notice.

TheNigeriaLawyer recalls that Falana & Falana’s Chambers had On October 25, 2024 requested the Chief Judge of the Federal High Court, Honourable Justice John Tsoho, to reassign a case filed against the Rivers State House of Assembly and others to a judge in the Port Harcourt Judicial Division of the Federal High Court.

The case remains pending before the Abuja division, with Mr. Falana expected to file the requested Motion on Notice to advance his application for its transfer to Port Harcourt.
