* No one has claim over cases struck out by court– Falana Hon Justice J.T. Tsoho’s ruling in the suit between Oluwatosin Ojaoma and President of the Senate of Federal Republic of Nigeria and the Attorney General of the Federation has generated much controversy. While some lawyers are of the opinion that the court has, by that judgment, removed the Acting Chairman of the Economic and Financial Crime Commission (EFCC), Mr. Ibrahim Magu, some others maintain a slightly contrary view. A Human Rights activist, Mr. Femi Falana, SAN, belongs to the latter school of thought. According to him, once the court strikes out a case no one can claim right over it. He also said that the court did not address Section 171 of the 1999 Constitution as amended. In his words: “the court did not order the removal of Mr. Magu as the Acting Chairman of the EFCC. It only struck out the case of the plaintiff for want of locus standing. However, the court further held that the Senate was vested with the power to confirm or reject the nominee of the President for the office of the Executive Chairman of the EFCC by virtue of section 2 of the EFCC Act.
