Joyce Oduah, FICMC, a prominent member of the Nigerian Bar Association (NBA), has announced her intention to challenge the decision by the Electoral Committee of the Nigerian Bar Association (ECNBA) to disqualify her from running for the office of President of the NBA.

In a press release issued by her supporters and friends on May 4, 2024, they expressed their dissatisfaction with the ECNBA’s decision, citing that Mrs. Oduah deserves better treatment as a respected member of the NBA with extensive experience and institutional knowledge of the association’s affairs.

The ECNBA based their disqualification on two grounds: Mrs. Oduah’s previous terms as Treasurer (2012-2014) and General Secretary (2020-2022), and the submission of a receipt for stamp and seal payment by her seconder instead of the Bar Practicing Fee receipt for 2024.

Mrs. Oduah’s supporters argue that the decision disregards the principles of fairness, justice, and the rule of law, emphasizing that the Nigerian legal system opposes the retrospective application of laws. They assert that there is no provision in the NBA Constitution stating that Section 9 (3) should apply retrospectively.

Furthermore, they maintain that the issue regarding the receipt submitted by Mrs. Oduah’s nominator is non-controversial and could have been easily rectified during the form opening stage.

Mrs. Oduah, known for her dedication and commitment to the legal profession, intends to pursue all legal avenues to challenge the ECNBA’s decision and reinstate her candidacy for the office of NBA President. Her supporters remain determined to uphold the principles of justice and fairness, ensuring that the rights of all NBA members are protected.
