Hon. Justice A. I. Chikere of Federal High Court Abuja on Friday, 22nd June, 2018, ruled on the issue of legal representation of the APC Chairman and National Working Committee in suit no. FHC/ABJ/CS/509/2018 in favour of Chief Joe-Kyari Gadzama. The matter was slated for hearing of the Defendants’ application to set aside the Consent Judgment entered in the matter on 19th June, 2018. The matter was between Odjebobo Desire Nayamefe – Ward 2 Uvwie LG, Delta State & Anor v. The National Chairman, APC & National Working Committee (NWC) APC. The Chairman of the APC, Chief John E. K Odigie-Oyegun, CON was personally present in Court. The Plaintiffs’ legal team was led by Alex Izinyon, SAN while both Chief Joe-Kyari Gadzama, SAN and Ebuka Nwaeze, Esq sought to announce appearance for the Defendants. Chief Joe-Kyari Gadzama, SAN informed the Court that he was briefed to represent the Defendants by the APC National Chairman who is the 1st Defendant and also heads the 2nd Defendant (APC National Working Committee) while Mr. Ebuka Nwaeze, Esq. informed the Court that he was briefed to represent the Defendants by the APC National Legal Adviser – Dr. Muiz Banire, SAN. The Plaintiffs’ Lead Counsel – Alex Izinyon, SAN also objected to the appearance of Chief Gadzama, SAN in the matter. The Court asked the 1st Defendant – Mr. John Odigie-Oyegun who was present in Court, who his Counsel was and he confirmed that Chief Joe-Kyari Gadzama, SAN was his authorized Counsel in the matter. The Court took arguments from both Counsel on the issue of legal representation and delivered ruling which resolved the issue in favour of Chief Joe-Kyari Gadzama, SAN as the authorised Counsel in the matter on behalf of the APC Chairman and National Working Committee. However, the matter could not proceed as it was thereafter adjourned to Thursday, 28th June, 2018 for Parties to address the Court on the issue of jurisdiction raised suo moto by the Court, as well as for the hearing of the pending application to set aside the consent judgment earlier entered on 19th June, 2018.]]>
