Eat N’ Go Ltd, a master franchise of Dominion Pizza Coldstone Creamery and Pinkberry has demanded for the immediate withdrawal of the online publication with respect to Suit No: LD/ADR/2709/2019 between Crompton Resources Ltd and Eat N’ Go Ltd, pending before the High Court of Lagos State.

In the letter of demand sighted by TheNigerialawyer (TNL), Dominion Pizza said that it is surprising that this is coming up especially now when the matter is pending before a Court of competent jurisdiction and sub-judice, adding that, there is no justification whatsoever for Crompton Resources Ltd to comment on a manner that is prejudicial to the case already before the Court. According to them, the online publication granted by Crompton Resources Ltd., has brought disrepute to Eat N’ Go Ltd., in the eye of the public.

Eat N’ Go Ltd., therefore, demanded that they take down the online publication and refrain from further commenting on the matter already before the Court pending the determination of the substantive suit, stressing that, the development shall be brought to the attention of His Lordship, Hon. Justice Femi-Adeniyi on the next adjourned date.

They further stressed that if after the receipt of the letter, Crompton Resources Ltd., fails, refuse, neglect to accede to accept to their demand, they will be left with no better choice than to take appropriate steps within the ambit of the law to seek redress.

TNL recalls that it was earlier reported that Crompton Resources Ltd had dragged a foreign owned company, Dominos’ Pizza, Cold Stone Ice-cream, to court over N34 million debt. It was reported that Crompton Resources Ltd was contracted by Eat N’ Go Ltd in 2018 to execute the construction of some of its outlets in Lagos; and that Eat N’ Go Ltd refused to pay the contract sum balance of N34, 000, 000.

The claimant was said to have condemned the conduct of Eat N’ Go Ltd as not just reprehensible but unbecoming of a company owned, controlled and managed by foreigners.

Justice Adeniyi Onigbanjo of the Lagos High Court Ikeja on March 3 fixed the 5th of May to hear the arguments for and against the application.
