Daily Law Tips (Tip 421) by Onyekachi Umah, Esq., LLM. ACIArb(UK)
*DEADLINE FOR APPEALS ON JUDGMENTS OF ELECTION TRIBUNALS IN NIGERIA.*
Litigation cannot run forever. There is time for everything under the earth. A loser in an election has right to go to court and challenge the outcome of an election. Such must be done within 21 DAYS after the date his election result was declared. And, an election tribunal must deliver its judgment within 180 days from the date of the filing of the petition.
Where a party to an election petition is not pleased with the judgment of an election petition such a party can appeal against the said judgment. Such appeal must be heard and judgment given within 90 days from the date of the delivery of judgment of the election tribunal.
My authorities are sections 134 and 158 of the Electoral Act, 2010.
