*Aggrieved Members Write Maikyau, Call For Dissolution Of Electoral Committee

The Nigerian Bar Association, Uyo Branch, has recently been undergoing leadership transition turmoil as the Chairman of the Nigerian Bar Association Elections Petitions Committee (East) has received a petition from one of the chairmanship candidate over an alleged electoral coup by the Electoral Committee of the Nigerian Bar Association, Uyo Branch on 24th May, 2023.

The petition which read and alleged that the NBA Uyo Branch Chairman, Ememobong Nicholas (AKA Aguda) has been alleged to, against the Uniform Byelaws for the branches of the NBA on the conduct of the elections set to midwife the election of Uwem Uko Umoh Esq., who is apparently unqualified to lead the State Bar Association.

The scheme by the Chairman, known as “Aguda,” began with the reappointment of Ekanem J. Ekanem, a former Branch Chairman, as Chairman of the Branch Eleco, over the objections of members who felt that Ekanem’s prior appointments had demonstrated that he is less than trustworthy and will always bow to the whims and caprices of the Branch Chairman. It was the aforementioned Ekanem J. Ekanem who, in his capacity as ELECO Chairman, made sure Aguda was re-elected without opposition by disqualifying a leading candidate for the Chairmanship in the previous elections.

Allegations points that Mr. Aguda, has seen that Ekanem, who was a former chairman of the branch had become the Chairman of the ELECO against the wish and protest of majority of the members of the Uyo NBA branch. The Ekanem-led electoral committee cleared all candidates who purchased forms, including the Chairman’s chosen candidate, for the position of Chairman of NBA, Uyo Branch, despite the protests of the majority of Branch members and in support of their plot to impose their preferred candidates on the lawyers’ body.

Mr. Uwem Uko Umoh was admitted to the bar on November 28, 2013, so he is not qualified to run for election to the position of Chairman of the (Uyo) Branch under the Uniform Byelaws for Branches because, as of the close of nominations for the election, he is not up to ten (10) years post-call.

Despite the numerous requests made in writing to the branch electoral committee for the disqualification of Uwem Uko Umoh Esq. and other candidates who did not adhere to the legal requirements outlined in paragraph 14(1)(a) of the NBA Uniform Bye-Laws, which states that a candidate must have at least ten (10) years post-call in order to be eligible to stand for election to the office of Chairman.  A person is considered to have reached a post-call year in computing the post-call years on each subsequent anniversary of his or her call to bar and not earlier, according to subsection (2) of the aforementioned paragraph.

The Ekanem-led electoral body has disregarded the law and begun a planned campaign to destroy the Branch, in flagrant violation of paragraph 15(3) of the aforementioned law, which states that no person, the Branch, its organ, or committee established by the Branch may waive the provision of the Bye-Laws relating to eligibility to vote or be voted for.

The Ekanem-led Electoral Committee produced electoral instructions that were a complete departure from the NBA’s uniform rules, as had been predicted. When questioned, the committee stated that it had the authority to set its own rules for the conduct of branch elections. Both the NBA Chairman and the Ekanem, during the last General Meeting of the Branch on Friday, May 26, 2023, had brandished an exparte court order after procuring a kangaroo order to restrain disqualification of candidates, who apparently where disqualified to participate in the elections. According to the ELECO Chairman who had trumpeted that, “I will abide by the court order, because the branch can establish guidelines for its election” he further emphasized that any other branch of the NBA is independent of the National NBA and can make laws to regulate its election.

A branch member from the Uyo NBA Branch wonders why NBA President Y. C. Maikyau has kept silent in the face of this injustice and requests that the national body get involved by dissolving the clearly corrupt Ekanem Jackson Ekanem’s committee and holding a credible election. According to a member of Elders Forum of the Branch, who pleaded to be anonymous, he is so shocked by how low Ekanem can go to perpetrate such evil plot and rape on the rule of law.

He claimed that the aforementioned Ekanem was a full participant in the discussions and decisions of the NBA Appeals Committee (East) on the petition filed by one Onyemachi Chukwu of the NBA Aba Branch that disqualified K. E. Nwangwa, who was admitted to the bar in October 2015, from running for election to the position of the Aba Branch’s Financial Secretary under the Uniform Byelaws for Branches because he was not a branch member. At the branch’s most recent bar meeting, the verdict of the Nigerian Bar Association (NBA) Appeals Committee (East) regarding the petition filed by Onyemachi Chukwu of the NBA Aba Branch on May 20, 2022, was distributed.

This leadership tussle is coming after the dust has settled on the crisis in the Branch occasioned by the Chairman dragging the Branch to unethically adopt the Governorship candidate, Pastor Umo Eno, of the PDP during the last elections, the outgoing Chairman of the Branch is up to more mischief. This time it is in his attempt to handpick a successor.

Ememobong Nicholas, the Chairman, has been mentioning Pastor Umo Eno as the person who has instructed him to make sure that their preferred candidate becomes the Chairman of the Branch in their effort to oust Uwem Uko Umoh Esq., the Chairman of NBA, Uyo Branch.
