An FCT High Court has granted an interim injunction restraining Goldenbird Investment Ltd and other unidentified persons from interfering with the ownership and possession of plots allocated for the Al-Barka Estate project in Wuye District, Abuja.

The court order protects plots 1841, 1842, 1843 and 1844, located in Cadastral Zone B03, Wuye, pending the hearing and determination of a substantive motion filed before it.

The claimants in the suit — Promiseland Building and Construction Ltd, Havencourt Apartment Ltd and En-Rose Nigeria Ltd — had approached the court through an ex parte application seeking protection of their proprietary rights over the disputed land.

In granting the application, the judge restrained the defendants, their agents, servants, representatives or assigns from interfering in any manner with the claimants’ ownership or possession of the plots until the motion on notice is determined.

The application was filed under suit number FCT/HC/CV/216/26 and motion number FCT/HC/M/685/26.

Reacting to what he described as inaccurate reports of the ruling, the Chairman and Chief Executive Officer of Promiseland Building and Construction Ltd, Ambassador Dr. Lawrence Emmanuel, clarified that the court did not restrain his company from developing the property.

He stated that the order instead protects the company’s proprietary and possessory interests in the Al-Barka Estate project.

“At no time did the court restrain or prohibit Promiseland Building and Construction Limited from carrying out development or enjoying other ownership rights in respect of its Al-Barka project,” he said.

He described contrary claims as misleading and urged members of the public to disregard such reports.

Emmanuel further advised prospective investors and the general public to verify title documents through the Abuja Geographical Information System (AGIS) and the Federal Capital Development Authority (FCDA) Department of Development Control to ensure proper due diligence.

The case is expected to continue once the motion on notice comes up for hearing.
