An FCT High Court sitting at Bwari in Abuja on 2nd September 2020 restrained the FCT Area Courts and the entirety of Nigeria Police Force from handling, entertaining, preceding over land matters in the disguise of any form whatsoever.

The FCT High Court holding at Bwari Abuja in Motion No: FCT/Hc/Bw/M/225/2020 presided over by Hon. Justice Oathman A. Musa in granting the reliefs of the applicant restrained all the defendants, FCT Area Court, Nigeria Police Force from entertaining and presiding over ownership of land matters referred to them by way of direct criminal complaints to the FCT Area Courts.

“That the Applicant to serve on the 1st and 2nd defendants on the application, an order of prohibition and certiorari against the proceedings of RT. HON. JIBRIL ISMAIL, Grade 1 Area Court, Karu Abuja in the suit of Bobai Francise v. Person Unknown (3rd applicant in this matter) and 3 others in Suit no: CR:175 /2020 by pasting same on fence of plot 1975, 1958 Kubwa extension 111b layout, Kubwa Abuja”

The presiding FCT High Court Judge also restrained the Nigeria Police Force from arresting, harassing, investigating under any guise whatsoever, the subject matter between all parties in the matter.

“That the orders above granted herein shall serve as a stay of proceedings in suit no CR/175/2020 and the above order served on the defendants/Respondent should mandate the respondents to maintain status quo as regards using the services of any FCT Area Court and or officers, Zonal Office, Command Office and Divisional Offices of (Nigeria Police Force) in arresting, intimidating, harassing an or taking any illegal and unauthorized steps against the Applicant/Plaintiff in this suit under the guise of investigation of any kind whatsoever as connected to the subject matter of this suit and or taking any illegal/reckless steps as regards the subject matter of this application which is referring vide criminal complaint to the RT. HON. JIBRIL ISMAIL,” the Court held.

Reacting to this, an Activist and Lawyer to the applicant, Ihensekhien Samuel Junior, Esq., gave kudos to the elaborate ruling of the Court, as he implored FCT Area Courts to desist and resist the temptation of handling title to land-related issues or land matters in general, where they have no jurisdiction whatsoever.

In his words, “this is the second time I am approaching the fct high court in other to restrain the FCT area courts to totally hands-off from handling land matters that border on the title to land.”

He also noted that he will further write officially to AGF, IGP of Nigeria Police Force on the need to comply with this Court ruling, even after different judgements against FCT Area Courts from handling land matters,.

He also thanked the applicant for choosing to toe the line of justice as regarding the above issue, as he also by this medium thanked the larger Abuja civil society group, who recently awarded him the funny title of (emerging and senior lawyer of the masses)sam,he then concluded.

The parties in the suit are Ferguson Ugochukwu and 2 others, Francise Bobai, Nigeria Police Force, and FCT Karu Area Court.
