*Says Previous order subsists

A high court sitting in Awka, Anambra State has declined to vacate the interim order seeking not to conduct another election for the people of Agulu Community.

The members of the Caretaker Committee of Agulu People’s Union had earlier scheduled December 27th and 30th to hold its elections.

However, Justice R.O Onunkwo, on 23rd Dec in the suit No NN/183/2021 Motion No: NN/593/2021, restrained the Defendants from holding the election.

TheNigerialawyer reports that the Defendants in the suit were Sir Onyebuchi Okpala, Joseph Muonago, MBA Obiora Cosmas Onwuasoanya.

Court in its ruling on Wednesday, 29th Dec, held that the previous order made  by Justice R.O Onunkwo, on 23rd Dec still subsist.

TheNigeriaLawyer recalls that controversies had earlier trailed the decision of the Anambra State Government, annulling the Union’s election that was held on 30th day of December, 2020.

Anambra State Government had also suspended the executive of Agulu and replaced it with a 27-Man Caretaker Committee, alleging that there were disputes over proper delegates accreditation; documented eruption of violence marred the proceedings and that Government observers could not discharge their functions.

In October 2021, another Caretaker Committee was reconstituted to conduct another fresh elections into the leadership of the union and its Youth Wing.

In the exparte motion filed and dated on the 22nd of December, 2021 and moved by Kaine Ananwune Esq, Counsel to the Plaintiff/Applicant, the Plaintiff prayed the Court to stall the conduct of the scheduled election.

The Court in granting the relief also ordered the Plaintiff to ensure that the originating process and accompanying documents in the suit be served all the respective defendants through substituted means.

The matter Motion on Notice was adjourned until 6th January for hearing
