A Federal High court sitting in Port Harcourt, Rivers State has ordered a witness in a matter before him to produce his covid-19 test certificate in next sitting to confirm his covid-19 symptoms claim of his Lawyer.

Mr. Iky Amadi was billed to give evidence in a suit, Yesin International Nigeria Limited Vs Wema bank, being presided over by Justice James Kolawole Omotosho Tuesday, but he was absent at the sitting.

The Plaintiffs Lawyer, B. Ejekwu informed the court that the witness was ill and presenting symptoms similar to those of Covid-19, so he advised him to go for the test, to ascertain his status.

He prayed the court to oblige them another opportunity in March to enable the witness to be fit enough to come to court the next time the case will be adjourned to, adding that he had earlier informed the defence counsel of the development.

Ejekwu said, “…my only witness in this matter is not in court this morning, when he came to our office Monday, I noticed that he was coughing; he equally complained of having headache and difficulty with breathing, so I asked him not to come to court this morning, but go and run COVID-19 test.

“After the visit, I quickly called the defence counsel and informed him of the development, he is aware of it, so in the light of this, I urge the court to grant us adjournment sometime in March so that even if it turns out to be the virus, the witness will have recovered and fit to be in court.”

The defence Counsel did not object to the application, Justice Omotosho granted it, but ordered that the witness filed the covid-19 test certificate before the court next adjourned date to proof the Lawyers claims.

“This matter is adjourned till March 16, 2021, for hearing. The witness Mr. Iky Amadi is ordered to file the covid-19 test result in whose instance this adjournment is granted before the next sitting.”

Earlier, the court had said, “I have not seen covid-19 test certificate before, so I am going to make an order that the witness produces his covid-19 certificate in court, at least, let me see how it looks, and also to know whether he tested positive or negative to the virus.”
