The National Industrial Court of Nigeria sitting in Abuja has granted an interim injunction restraining the Nigeria Immigration Service and other defendants from implementing disciplinary recommendations against one of its officers, Dr. Badiru Adeyemi Oluwafemi, pending the determination of a substantive suit.

Justice E.D. Subilim issued the order in Suit No. NICN/ABJ/235/2026, following an ex parte application filed by Oluwafemi on June 29, 2026.
The defendants in the suit are the Nigeria Immigration Service, the Comptroller-General of the Nigeria Immigration Service, the Civil Defence, Correctional, Fire and Immigration Services Board, the Senior Staff Disciplinary Committee of the Nigeria Immigration Service, and the Comptroller of Immigration in charge of Discipline and Awards.
In the application, Oluwafemi asked the court to restrain the defendants, their agents or privies from writing, accepting or implementing the recommendations of the Senior Staff Disciplinary Committee arising from its meeting held between June 23 and June 25, 2026.
He also sought an order stopping the defendants from taking any step connected with the disciplinary proceedings pending the hearing and determination of the substantive suit.
The claimant further asked the court to restrain the defendants from preventing him from participating in the 2026 promotion examination.
He also sought protection from further disciplinary action over issues relating to his posting from the Lagos State Command to the Keffi Command, which he said is already the subject of a pending court case.
Oluwafemi additionally prayed the court to restrain the defendants from arresting, harassing, intimidating, querying, summoning, terminating or dismissing him in connection with the matter before the court.
After considering the ex parte application, supporting affidavit and written address, Justice Subilim held that the claimant had established a prima facie case warranting the grant of interim relief.
The court consequently granted the application as prayed in the interest of justice.
Justice Subilim also directed that the defendants be served with all court processes, including the motion on notice, within seven days.
The matter was adjourned to July 10, 2026, for hearing of the motion on notice.
