A FEDERAL High Court sitting in Osogbo, Osun State, yesterday, granted an application for the amendment of a suit filed by the Peoples Democratic Party (PDP) in the state, seeking the stoppage of the state local council election slated for October 15, 2022 by the Osun State Independent Electoral Commission (OSIEC).
In his ruling, Justice Emmanuel Ayoola over-ruled OSIEC’s objection and granted PDP’s amendment application.
The court also struck out an objection to discontinue the case on the ground that it lacked jurisdiction to hear the matter.
Counsel to OSSIEC, Abiodun Saka-Layoonu (SAN), filed the objection.
Counsel to the PDP, Hashim Abioye, said the plaintiff had sought an amendment to the suit, before the defendant’s plea, which the court failed to grant.
According to him, “The court did not stop the local government election. It only overruled the injunction they sought against our case.
“The PDP filed an application for amendment, but the APC objected to the case and asked the court to strike it out, that it lacked the jurisdiction to hear the case.
“The court, therefore, overruled their objection, to strike the case out and did not rule on the application to stop the conduct of the election.
“The implication of this is that they must not do anything as preparation for the election yet.”
The court adjourned the suit till September 26, 2022 for hearing.
