The Lagos High Court has issued an interim order restraining the Inspector General of Police,The Assistant Inspector General of Police (Zone 2,Onikan) and other Respondents including NIBSS Plc from further threatening, harassing or attempting to arrest retired Justice Caroline Olufawo and her daughter, Engr. Oludayo Olufawo.

Justice O. Atinuke Ipaye granted the interim injunction on Monday,27th November,2023 while ruling on a motion exparte application brought under the fundamental human rights rules in a Fundamental Rights suit instituted by the Olufawos against the police chief, three police officers of the AIG zone 2,Onikan,Lagos, two private individuals and a company, NIBSS Plc

The retired judge and her daughter accused the respondents of trying to breach their rights and safety over a property dispute being litigated separately at the Lagos high Court. The Honourable Court opined in it’s ruling that it appeared that the Police were acting the script of the 9th Respondent(NIBSS Plc) and other unknown persons.

Justice Ipaye found merit in the applicants’ arguments and urgent need for relief pending determination of the substantive case. The restraining order bars the police from taking any adverse action against the retired judge and her daughter concerning the disputed Lagos property.

The ruling follows disturbing allegations of abduction and detention levelled against the police. Justice Ipaye directed the Olufawos to serve court processes on the respondents and also file an undertaking to pay damages if the injunction ought not to have been made

The court fixed Dec. 12th 2023 to hear the substantive fundamental rights suit in order to fully unravel the circumstances and provide lasting protections for both applicants.

Legal analysts hail the firm restraint against police overreach in going after a retired judicial officer. They opined the interim order reaffirms citizens’ trust in the impartiality of courts to check excesses by security agencies.
