A Rivers State High Court hearing the trial of the Deputy Chief Registrar of the Federal High Court, Awka Division, Mrs Nkem Mba, has adjourned to the 7th of December for ruling on a No-Case Submission by the Defendant against the case made out by the Prosecution.
When the case marked SUIT NO: PHC/2109/CR/2022 came up today, Counsel for the Defendant and Prosecution were in Court alongside the Defendant, we was physically present.
The Learned Silk for the Defendant informed the Court of the pendency of the Addresses filed by the parties with respect to the plea of no-case submission raised by the Defendant. By way of adumbration, he informed the Court that there was no prima facie case disclosed against the Defendant, and that there was no iota of evidence whatsoever, linking the Defendant with the Charges against her. The Learned Silk referred the Court to the Bank Statement tendered by the Prosecution, to show that the Defendant received money from the PW2, he pointed out that on the day the Prosecution alleged that the PW2 paid money to the Defendant, there was no credit inflow into her account by the PW2.
It was also pointed out, that the evidence of the PW4 actually nailed the coffin of the Prosecution’s case, as the witness confirmed to the Court, the position that by virtue of Order 16, Rule 4(2) of the Admiralty Jurisdiction Procedure Rules, 2011, an Admiralty Marshall (Substitute) was entitled to 2% of the sale pursuant to admiralty executions, to cover the expenses incurred.
The Learned Counsel for the prosecution also adopted his Address, by way of adumbration, he submitted that there was a case made out against the Defendant, and it was only right for her to defend herself and state her side of the story.
The matter was thereafter adjourned to the 7th day of December, 2022 for Ruling on the no case submission.
