The Attempt by an Abuja-based Lawyer, Maxwell Opara to stop the sale of Polaris Bank failed today as the Federal High court 2 presiding over by Justice Binta Nyako refused his application exparte and asked him to put the CBN and other parties on Notice. The matter adjourned to 24th November, 2022 for hearing.
TheNigeriaLawyer recalls that the motion ex parte which had been brought before the Federal High Court, sitting at Abuja in suit no FHC/ABJ/CS/1847/2022 filed by the claimant, Maxwell Opara wherein he sought an order restraining the defendants; CBN, Asset Management Corporation of Nigeria, The President, Nigerian Senate, Speaker, House of Representatives, AG of The Federation, Federal Ministry of Finance and Polaris Bank from engaging in the sale of Polaris Bank, on the grounds that the 1st, 2nd and 6th defendants acted ultra vires when they approved the sale of the Bank without any regard to Section 6(5) and 28 of the Assets Management Corporation of Nigeria Act, 2010 (as amended), thereby invalidating the sale.
Upon hearing the motion before it, the Federal High court 2 presided over by Justice Binter Nyako refused this application exparte by the claimant, Maxwell Opara and asked that he put CBN and others on Notice.
The matter was later adjourned to 24th November, 2022 for hearing.
