*Defendants plan no-case submission

The prosecution in the trial of a relative of Senator Ademola Adeleke – Sikiru Adeleke and three others – for alleged examination malpractices has said it had concluded its case.

The other defendants are: Alhaji Aregbesola Mufutau (the Principal of Ojo-Aro Community Grammar School, Ojo-Aro, Osun State), Gbadamosi Thomas Ojo (the school’s Registrar) and Dare Samuel Olutope (a teacher in the school).

At the mention of the case yesterday before a Federal High Court in Abuja, lead prosecution lawyer Simon Lough told the court that, having called five witnesses, the prosecution had decided to close its case.

The defence team, led by Nathaniel Oke (SAN), did not object to the prosecution’s decision to close its case, but informed the court that the defendants would make no case submissions.

Oke, who represented Adeleke (the first defendant), said having assessed the evidence led by the prosecution through its witnesses, his client found that no prima facie case was made against him to warrant him being called to enter a defence.

He said his client has decided to make a no-case submission in that regard, a position the lawyers to the other three defendants echoed.

Ruling, Justice Inyang Ekwo ordered the defendants to file and serve their written submissions within 10 days, with the prosecution having 14 days to reply.

The judge gave the defendants another three days to file their reply on point of law.

Justice Ekwo adjourned till November 10, 2020, for the adoption of parties’ addresses.
