Adegboruwa, Ebun-Olu Samuel

Today, some legal wigs were conferred with the rank of Senior Advocate of Nigeria, (SAN) which is the highest rank to be given to a legal practitioner in Nigeria.

Persons conferred with the rank are persons of sound legal antecedents; they are persons that have contributed immensely to the development of the legal profession in Nigeria as laid down in the relevant Laws. One of such persons who have fulfilled the criteria laid down in the Law and will soon be robed with the silk is Mr. Adegboruwa, Ebun-Olu Samuel.

Adegboruwa, Ebun-Olu Samuel was born on March 21, at Ode-Etikan in Ilaje Local Govt Area of Ondo State. He is a Prince of the stock of Ropeda Ruling house, which has produced the past Olikan of Etikanland, His Royal Majesty, Oba Gbadebo Adesuyi Okunfeyiwa, Ropeda 1.

Mr Adegboruwa attended St. Luke’s Primary School, Ode-Etikan; Ilaje Grammar School, Atijere; Community Grammar School, Zion-Pepe; Obafemi Awolowo University, Ile-Ife; Nigerian Law School, Lagos. He was called to the Nigerian Bar in 1995, whereupon he joined Gani Fawehinmi Chambers, from 1995 to 2000, when he set up Adegboruwa and Company.

He is the Pastor in charge of Zone 1 of the Redeemed Christian Church of God, Lagos Province 20. For his pastoral calling, he attended the Leadership Institute for Bible Studies, Ikoyi, Lagos; The Redeemed Christian Bible College, Lagos; The Redeemed School of Disciples, Lagos; The Redeemed School of Missions, Lagos and Ede.

Interests:

Public interest litigation, progressive advocacy, constitutional law cases, election petitions, human and civil rights advocacy and general litigation and above all, doing the work of God.

Experience:

Adegboruwa was an active students’ leader in the university. He was Public Liaison Officer, Law Students’ Society of Obafemi Awolowo University, Public Relations Officer and later President, Obafemi Awolowo University Students’ Union, 1992-1993; Member, Senate of National Association of Nigerian Students (NANS), 1992-1994; member, Legal Committee of United Action for Democracy; Acting Publicity Secretary, United Action for Democracy; (2002); Founder and President, GSM Subscribers Association of Nigeria; former Deputy Editor, Human Rights Law Reports of Africa; former Senior Assistant Editor, Nigerian Weekly Law Reports; founder, Law and Justice Forum; public affairs commentator and analyst, social critic and pro-democracy activist;

Adegboruwa is cited in Nigeria’s Who is Who, page 41 and he has appeared to prosecute and defend cases in all courts in Nigeria, from Customary Courts to Magistrate’s Courts, Tribunals, High Courts, Court of Appeal to the Supreme Court.

Adegboruwa is actively involved in public interest litigation for the protection and defence of the rights of the common man.

He defended murder charge against Professor J.G Chinwa of the Rivers State University of Science and Technology and the case to re-instate him back into the University against unlawful dismissal;

He was part of the Ogoni Civil Disturbances Tribunal constituted that tried Ken Saro Wiwa, Ledum Mitee and other Ogoni activists in Port Harcourt;

He handled the case to secure bail for the Ogoni 19 on behalf of Chief Gani Fawehinmi;

He successfully defended criminal charges against OPC President, Gani Adams, by the state;

He prosecuted the landmark Supreme Court case of Fawehinmi v. Abacha on the status of the African Charter on Human and Peoples’ Rights, up to the Supreme Court;

He is currently handling various cases on land disputes, chieftaincy, contracts, maritime, constitutional law, tort, matrimonial causes, company disputes, libel, election petitions, landlord and tenant, etc.

Adegboruwa pioneered the legal struggles against the collection of toll fees on roads and bridges, leading to the landmark judgment of the Federal High Court, in March 2014, which annulled the toll collection;

In 2016, Adegboruwa filed a suit at the High Court of Lagos State, to stop the planned privatisation of the Probate Registry;

In March 2016, Adegboruwa secured judgment from the Federal High Court, Lagos, which annulled the restriction of human and vehicular movements on the last Saturdays of every month on account of environmental sanitation;

In February 2017, Adegboruwa filed a suit at the Federal High Court, Lagos, to compel the President to accept the recommendation of the Honourable Justice Walter Onnoghen as the Chief Justice of Nigeria;

He is a devoted Christian and a minister in the Redeemed Christian Church of God, where he has served and is still serving in various capacities.

Adegboruwa v Governor – constitutional case filed in court to determine the legality of Senator Bola Ahmed Tinubu handing over to the Speaker of the House of Assembly rather than the Deputy Governor, whilst proceeding on his annual vacation.

Fawehinmi v. I.G.P. – constitutional case on interpretation of section 308 of the 1999 Constitution on immunity of Governor from police investigation.

Fawehinmi v. Abacha – constitutional case on effect of Decrees made by the military government on the African Charter on Human and Peoples’ Rights for the detention of citizens indefinitely

Adegboruwa v Governor – constitutional case on whether a Governor can hand over the reigns of power to any other officer other than the Deputy Governor when he travels abroad or is otherwise unavailable

 Nkanna v. Governor – landmark case on the effect of Sections 8 and 9 of the Education Law of Lagos State on free education in primary and secondary schools in Lagos State

Adegboruwa v. MTN – case on the poor state of GSM services offered by the network providers and the corresponding high tariff

Uwagbue v. A-G. Lagos – constitutional case filed on behalf of 50 prisoners in conjunction with the Civil Liberties Organisation to challenge their indefinite detention as awaiting trial inmates

Adegboruwa v.  A-G, Federation – constitutional case involving the challenge to the imposition and collection of toll fees on roads and bridges in Lagos State.

Adegboruwa v Senate – constitutional case to determine the effect of rejection of nomination of candidate for the office of Chairman, EFCC;

Adegboruwa v President – constitutional case to compel the President to accept the recommendation of the National Judicial Council, for the office of Chief Justice of Nigeria;

Adegboruwa v Nigeria Customs Service – case filed to determine the legality of appoint the Comptroller-General of Customs from outside the customs.

Adegboruwa v  President, case filed in court to compel the President to appoint his ministers within a specific time;

Adegboruwa v A.G.F., case filed in court to challenge the illegal composition of the Board of AMCON;

Adegboruwa v A-G. case filed in court to determine the legality of police strike.

Yinka Odumakin v  Nigeria Police Force – case filed in court to stop the politicisation of the recruitment of police recruitment.

Adegboruwa v President – case filed in court to determine the legality of the deployment of troops to Lagos State in 2012, to quell the anti-fuel subsidy protests.

Record of political activism:

(i)      arrested, detained and dismissed along with 61 other OAU student leaders in 1992 for participating in student protest but re-instated by court;

(ii)     victimized and made to repeat year 3 in OAU Faculty of Law by the dean who objected to his participation in students union. Later promoted upon review by another panel of teachers;

(iii)    arrested, detained and charged to court along with late Dr. Beko Ransome-Kuti, Chima Ubani, etc for organising June 12 protests;

(iv)    arrested and detained at Police Headquarters, Enugu in 1993 for attending NANS Senate meeting in Enugu against government ban;

(v)     arrested, detained and remanded in underground cell of the Directorate of Military Intelligence by General Sani Abacha from November 1997- July 1998 (9 months).

Adegboruwa is married to Mrs. Oreka Adegboruwa, a lawyer and they are presently blessed with five children.
