The matter of Hameed Ajibola Jimoh Esq v. A.G.F with suit no: FHC/ABJ/CS/1103/2017 which is the case in question was brought by way of an Originating Summons seeking to annul Section 2 of the Terrorism Prevention Act which allows an Exparte order of court declaring & proscribing a group as a terrorist group absolutely, without giving the said group the opportunity of being heard before the final order. Also to be contested is Section 4 which has the tendency of incriminating a lawyer rendering legal services to such proscribed group. TheNigerialawyer recalls that the IPOB has been proscribed a terrorist organization upon an Ex parte application by the Attorney General of the Federation which led to arguments and counter-arguments by Cousel in the Legal community. Some had argued that Section 2 is a violation to the right of fair hearing granted the organization as an artificial person, while others have argued that IPOB is yet to be registered under the Nigerian Laws and as such, not entitled to such right. Although the case is yet to be assigned to a judge, it is believed that the eventual order of the court on the matter will give a head-way concerning the boiling legal issue.]]>
