Mr. Ikeazor Akaraiwe, 1st Vice-President of NBA from 2008-2010 has voiced out his thoughts on the current administration fight against corruption in the Judiciary. He made his stands known in a statement issued on the 1st year anniversary of the controversial arrests of judges. TheNigerialawyer recalls that on the 7th of October, 2016, being exactly one year ago, the Department of State Security in the midnight stormed the homes of some judges across various hierarchies of courts in Nigeria, on allegations of corruption. The action by the government agency attracted criticisms from the legal community home and abroad on the ground that the action was not right in Law. One year after, Mr. Ikeazor Akaraiwe, has given a thorough assessment of the fight against corruption in the Judiciary right from the storming of the judges’ home up till date. He noted that One of the judges has been tried to conclusion, and discharged and acquitted; with an appeal filed against his acquittal. A couple of others, notably the then Chief Judge of Enugu State has been retired, while a couple of others are having their days in court and at least one has neither been tried nor spoken about. Mr. Ikeazor Akaraiwe in giving an evaluation asked some questions that need be answered. – Whether the October 7, 2016 event has significantly impacted corruption in the judiciary for the better; – Whether there are other more effective ways for curbing judicial corruption; – Whether some judges like Hon. Justice Inyang John Okoro JSC who was a victim of the midnight arrests but has neither been arraigned nor interdicted, did not have their reputations unnecessarily besmirched by the October 7 action, and as a corollary, whether such judges are not entitled to a formal clean bill of health by the DSS. Mr. Ikeazor Akaraiwe though affirming his support for the fight against corruption however stated that the step so far taken is more like doing the right thing in the wrong way. In his words: ”I lend my voice to the imperative of having a justice delivery sector devoid of corruption; but within the perimeters and parameters of the Rule of Law. October 7, 2016 was a wrong way to pursue a right thing in my respectful view. If a judge is tainted with corruption, the last defence of society from the Hobbesian state of jungle justice would be lost…” He is therefore of the opinion that other ways or methods should be employed to achieve the desired results. ”The campaign against corruption must therefore be retooled in such a way that it is not characterised by speculation and a deliberate attempt to demystify and humiliate the justice delivery sector”, he said.]]>
