The letter which was dated the 5th day of October, 2017 and signed by Chukwudi IgweChMc, the National Coordinator of the NGO, disclosed that the continual occupancy of the Igbo-Etiti/Uzo-Uwani Federal Constituency seat at the House of Representatives by Princess Stella Ngwu despite the death of Dr. Gabriel A. Okafor which abated the appeal by Princess Stella Ngwu amounts to contempt of court. TheNigerialawyer recalls that the Federal High Court had in Suit No. FHC/ABJ/CS/1088/14 delivered a judgment on October 14, 2016 where it held that Late Dr. Gabriel A. Okafor won the PDP party primary election held on December 6, 2014 for Igbo-Etiti/Uzo-Uwani Federal Constituency election into the House of Representatives. The court had ordered the Independent National Electoral Commission to issue the Late Dr. Gabriel A. Okafor with Certificate of Returns in respect of the House of Representatives election for Igbo-Etiti/Uzo-Uwani Federal Constituency of Enugu State and as well ordered Princess Stella Ngwu to vacate the seat of Igbo-Etiti/Uzo-Uwani Federal Constituency with immediate effect and to further refund to the coffers of the National Assembly of Nigeria all monies she collected by way of salaries, allowances howsoever described since she took the seat in the House of Representatives as a result of the 2015 general elections under the pretense of being the duly elected candidate of the PDP to represent Igbo-Etiti/Uzo-Uwani Federal Constituency of Enugu State. However, after the Independent National Electoral Commission issued the Late Dr. Gabriel A. Okafor with the said Certificate of Return as ordered by the court, Princess Stella Ngwu filed an appeal at the Court of Appeal challenging the judgment of the Federal High Court which declared Late Dr. Gabriel A. Okafor the winner of the said PDP party primary held on December 6, 2014 before his death. The group argues that the issuance of the Certificate of Return by the Independent National Electoral Commission is in compliance with the said judgment of the Federal High Court, therefore the pending appeal on the said suit has abated automatically as a result of the demise of Dr. Gabriel A. Okafor, who was the Respondent in the appeal and as such can no longer be maintained in the form it was originally presented. According to the wordings of the petition: “We make bold to say that the continuous occupation of the said seat by Princess Stella Ngwu is in total disobedience of the judgment of the Federal High court and as such, a contempt of court on her part and that of the Honourable House. In the light of the foregoing, we humbly request the Honourable Speaker to declare the seat of the Igbo-Etiti/Uzo-Uwani Federal Constituency of Enugu State vacant and consequently invite the Independent National Electoral Commission to conduct a Bye Election to fill the gap. We further request the Honourable Speaker to comply with the order of the Federal High Court in suit No. FHC/ABJ/CS/1088/14 by ensuring that Princess Stella Ngwu refunds to the coffers of the National Assembly of Nigeria all monies she collected by way of salaries and allowances under the pretense of being the duly elected candidate of the PDP for Igbo-Etiti/Uzo-Uwani Federal Constituency. Kindly note that we will be left with no other option than to approach the court for justice, if this request is not given its desired attention within 14 days.” The petition despite being addressed to the Speaker of the House, copied the Clerk of the National Assembly of the Federal Republic of Nigeria and as well as Princess Stella Ngwu, the honourable member against whom the petition is brought.]]>
