Human rights lawyer, public interest advocate and Freedom of Information campaigner, President Aigbokhan, has been selected to serve as the presiding judge in the semi-final rounds of the Wahab Egbewole, SAN National Disability Moot Court Competition scheduled to hold at the University of Ilorin.

The competition, named after Prof. Wahab Egbewole, SAN, Vice Chancellor of the University of Ilorin, is regarded as one of the leading platforms for promoting disability rights education and advocacy among Nigerian law students.

The finals of the competition will form part of activities surrounding the conference of the African Network of Constitutional Lawyers, which is expected to bring together academics, jurists, legal practitioners and policymakers from across Africa.

Aigbokhan’s selection is seen as recognition of his longstanding commitment to human rights, constitutionalism, access to justice and public interest litigation.

Over the years, he has distinguished himself through strategic litigation, legal advocacy and capacity-building initiatives aimed at promoting transparency, accountability and the protection of vulnerable groups.

His work before domestic and regional courts has also contributed to the development of human rights law and public interest jurisprudence in Nigeria and West Africa.

The organisers noted his advocacy in Unemployed Youths of Nigeria v. Federal Republic of Nigeria & Ors, Suit No. ECW/CCJ/APP/51/2020, a case filed before the ECOWAS Court challenging alleged discriminatory recruitment criteria used by the Department of State Services.

In the suit, the applicants challenged DSS recruitment guidelines which allegedly disqualified candidates with natural disabilities, including stammering, and those who had undergone orthopedic operations.

They argued that the guidelines violated disability rights and called for compliance with disability inclusion standards, including a minimum five per cent employment opportunity for persons with disabilities.

Aigbokhan, who represented the applicants, argued that strict and unaccommodating recruitment policies could exclude otherwise qualified applicants and undermine the rights of persons with disabilities.

The court, however, held that exclusion from a particular job based on inherent job requirements would not automatically amount to discrimination, especially where the nature or complexity of the job requires certain qualifications or physical capacities.

The court stated that such exclusion would only amount to discrimination where there is uncontroverted proof that the affected persons could adequately perform the job despite the stated limitations.

On the allegation of regional imbalance in recruitment, the court held that the applicants failed to provide sufficient evidence showing that candidates from the South performed better than candidates from the North but were denied employment.

The court also noted that Nigeria had not ratified the Protocol to the African Charter on the Rights of Persons with Disabilities and could not be held liable for violating an instrument to which it was not a party.

Speaking on his appointment, Aigbokhan thanked the organisers for the confidence reposed in him and commended the initiative for promoting legal scholarship on disability rights.

He said the protection of persons with disabilities remains one of the defining human rights challenges of contemporary society and requires sustained engagement by the legal profession.

The Wahab Egbewole, SAN National Disability Moot Court Competition has been held for three years and continues to attract leading faculties of law from across Nigeria to engage emerging legal issues affecting persons with disabilities and the development of disability rights jurisprudence.
