US Citizenship and Immigration Services will raise premium processing fees for immigrant worker petitions, work permits, and other benefits beginning in March.

Effective March 1, fees will reflect inflation based on the Consumer Price Index between June 2023 and June 2025.

Premium processing payments for the I-129 form for non-immigrant workers and the I-140 form for immigrant workers will go up from $2,805 to $2,965. The fee for employment authorization documents will increase from $1,685 to $1,780. Fees for the I-539 form to extend or change non-immigrant status will go up from $1,965 to $2,075.

What Is Changing?
Starting March 1, 2026, any Form I-907, Request for Premium Processing Service, postmarked on or after this date must include the updated fee. The adjustment reflects a 5.72% increase in CPI-U over the two-year period.

Updated Premium Processing Fees
Form I-129 (H-2B or R-1 classifications):
From $1,685 → $1,780

Form I-129 (all other eligible classifications):
From $2,805 → $2,965

Form I-140 (employment-based immigrant petitions):
From $2,805 → $2,965

Form I-539 (F, J, M classifications):
From $1,965 → $2,075

Form I-765 (employment authorization):
From $1,685 → $1,780

Why the Adjustment?
Under the USCIS Stabilization Act, DHS is authorized to make biennial inflation-based adjustments to premium processing fees to maintain the real dollar value of expedited services. This ensures USCIS can continue to:

  • Provide timely premium processing services
  • Improve adjudication processes
  • Address backlogs and operational demands

Estimated Impact
The rule is expected to generate approximately $77 million annually in additional revenue, which will be used to support USCIS operations and enhance service delivery.
